Cumhuriyetin kolay kurulmad\u0131\u011f\u0131n\u0131 kaydeden K\u0131l\u0131\u00e7daro\u011flu, \u201cBa\u011f\u0131ms\u0131zl\u0131\u011f\u0131m\u0131z\u0131 kolay elde etmedik. T\u00fcrkiye Cumhuriyeti&#8217;nin birli\u011fini ve dirli\u011fini sa\u011flamak i\u00e7in 1920\u2019lerden ba\u015flayarak \u00f6nce Cumhuriyeti kurmak, TBMM\u2019yi toplamak gibi \u00e7ok \u00f6nemli ad\u0131mlar at\u0131ld\u0131.<\/p>\n<p>1920\u2019lerden bu yana pek \u00e7ok ac\u0131 tablo ile kar\u015f\u0131la\u015ft\u0131k. Ama bug\u00fcn geldi\u011fimiz noktada gelece\u011fe d\u00f6n\u00fck umutlar\u0131 ye\u015fertmek zorunday\u0131z. Baz\u0131 \u00e7evreler \u2018Ne demek kontroll\u00fc darbe giri\u015fimi\u2019 diye tepki g\u00f6sterdi. \u015eu soruyu sorduk; Bu darbe giri\u015fiminden sizin \u00f6nceden haberiniz var m\u0131yd\u0131? Bu sorunun yan\u0131t\u0131 \u015fuana kadar al\u0131nm\u0131\u015f de\u011fil. Biz rejim de\u011fi\u015ftiriliyor dedi\u011fimiz zaman \u2018hay\u0131r niye rejim de\u011fi\u015fsin\u2019 diyorlar. Tek adam rejimi ile siz parlamenter demokratik sistemi ask\u0131ya ald\u0131\u011f\u0131n\u0131z zaman rejimi de\u011fi\u015ftiriyorsunuz demektir. Yetkileri bir ki\u015finin \u00fczerine veriyorsunuz.<\/p>\n<p>Tek ki\u015fi her \u015feye egemen oluyor. Yap\u0131lan de\u011fi\u015fiklik y\u00fcr\u00fcrl\u00fckteki anayasam\u0131za g\u00f6re de kendi i\u00e7inde ciddi \u00e7eli\u015fkiler ortaya \u00e7\u0131kart\u0131yor. Oturulup d\u00fc\u015f\u00fcn\u00fclm\u00fc\u015f, tart\u0131\u015f\u0131lm\u0131\u015f bir de\u011fi\u015fiklik de\u011fildir. Ger\u00e7ekten insan bazen \u015fa\u015f\u0131r\u0131yor. Cumhurba\u015fkan\u0131n\u0131n tarafs\u0131z olmas\u0131 anayasan\u0131n temel ilkesi. Yap\u0131lan de\u011fi\u015fiklik ile cumhurba\u015fkan\u0131n\u0131n tarafs\u0131zl\u0131\u011f\u0131 ask\u0131ya al\u0131n\u0131yor. Ayn\u0131 zamanda ba\u015fkan bir siyasi partinin de genel ba\u015fkan\u0131 olacak. Bir siyasi partinin genel ba\u015fkan\u0131 tarafs\u0131z olamaz. Bir milletvekili tarafs\u0131z olamaz. Zaten yemininde de tarafs\u0131zl\u0131k yoktur. Ama anayasada cumhurba\u015fkan\u0131n\u0131n parlamentoda yapaca\u011f\u0131 yeminde tarafs\u0131zl\u0131k ilkesi var. Bu ne perhiz bu ne lahana tur\u015fusu. Say\u0131n Cumhurba\u015fkan\u0131 a\u00e7\u0131klad\u0131, bir insan\u0131n karakterinde tarafs\u0131zl\u0131k olur mu, olmaz. Do\u011fru diyor. Ben bir partinin genel ba\u015fkan\u0131 olacaksam tarafs\u0131z olamam. Benim partimin program\u0131, hedefleri, ilkeleri vard\u0131r. Kendi i\u00e7inde temel bir \u00e7eli\u015fkiyi ortaya \u00e7\u0131kartan bir anayasa de\u011fi\u015fikli\u011fine ne diyece\u011fiz\u201d ifadelerini kulland\u0131.<\/p>\n<p>Yarg\u0131n\u0131n ba\u011f\u0131ms\u0131z ve tarafs\u0131z olaca\u011f\u0131n\u0131n s\u00f6ylendi\u011fini, herkesin de bunu istedi\u011fini belirten K\u0131l\u0131\u00e7daro\u011flu, \u201cYarg\u0131n\u0131n ba\u011f\u0131ms\u0131z ve tarafs\u0131z olmas\u0131, temel haklar\u0131m\u0131z\u0131n g\u00fcvence alt\u0131na al\u0131nmas\u0131 a\u00e7\u0131s\u0131ndan \u00e7ok \u00f6nemli. Bir partinin genel ba\u015fkan\u0131 Anayasa Mahkemesinin 15 \u00fcyesinden 12\u2019sini tayin ederse orada yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131ndan s\u00f6z edilir mi? Bir siyaset\u00e7i e\u011fer hakim tayin ediyorsa orada yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 olmaz. Kendi i\u00e7 \u00e7eli\u015fkilerini kendi i\u00e7inde ortaya \u00e7\u0131kart\u0131yor. Anayasam\u0131z, \u2018Egemenlik kay\u0131ts\u0131z \u015farts\u0131z milletindir\u2019 diyor. Anayasa \u015funu s\u00f6yler; egemenli\u011fin kullan\u0131lmas\u0131 hi\u00e7bir ki\u015fiye, s\u0131n\u0131fa, z\u00fcmreye b\u0131rak\u0131lamaz. Millete aittir. Biz \u015fimdi egemenli\u011fi bir ki\u015fiye veriyoruz. Yeni anayasada \u2018T\u00fcrk milleti egemenli\u011fi yetkili organlar\u0131 eliyle kullan\u0131r\u2019 diyor. Yasama, yarg\u0131 ve y\u00fcr\u00fctme. B\u00fct\u00fcn bir yetkiyi bir ki\u015fiye ba\u011flad\u0131\u011f\u0131n\u0131z zaman otomatikman bu maddelerin tamam\u0131n\u0131 ask\u0131ya alm\u0131\u015f oluyorsunuz.<\/p>\n<p>B\u00fct\u00fcn yetkilerin bir ki\u015fiye ba\u011flanmas\u0131n\u0131n ne sonucu olacak? Hi\u00e7 kimsenin can ve mal g\u00fcvenli\u011fi olmayacak. Anayasa, \u2018yasama yetkisi, T\u00fcrk milleti ad\u0131na TBMM\u2019nindir\u2019 diyor. Yeni anayasa de\u011fi\u015fikli\u011fi ile devletin yap\u0131s\u0131 ve i\u015fleyi\u015fi ile ilgili d\u00fczenlemeleri TBMM de\u011fil ba\u015fkan belirleyecek. Kendi i\u00e7inde \u00e7eli\u015fkiler var. Bu Meclisi bir ki\u015fi hi\u00e7bir gerek\u00e7e g\u00f6stermeden feshedebilecek.
