Bu fesih \u015fekli de i\u015f\u00e7inin k\u0131dem ve ihbar tazminatlar\u0131na hak kazanmas\u0131na engel te\u015fkil etmedi\u011finden davac\u0131n\u0131n k\u0131dem ve ihbar tazminat\u0131 taleplerinin kabul\u00fc gerekir.&#8221; ifadeleriyle milyonlarca i\u015f\u00e7iyi yak\u0131ndan ilgilendiren emsal bir karara imza att\u0131.<\/p>\n<p>Kayseri&#8217;de \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015f yeriyle ayn\u0131 sekt\u00f6rde faaliyet g\u00f6steren ba\u015fka bir fabrikadan daha iyi \u015fartlarda teklif ald\u0131\u011f\u0131 iddia edilen i\u015f\u00e7i, i\u015fveren taraf\u0131ndan bilin\u00e7li olarak performans\u0131 d\u00fc\u015f\u00fcrd\u00fc\u011f\u00fc gerek\u00e7esiyle &#8216;hakl\u0131 fesih&#8217; hakk\u0131n\u0131 kullan\u0131l\u0131p kap\u0131 \u00f6n\u00fcne konuldu. Y\u0131llarca \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015f yerinden tazminats\u0131z \u015fekilde at\u0131lan i\u015f\u00e7i, ilk olarak Kayseri 2. \u0130\u015f Mahkemesi&#8217;nde alacak davas\u0131 a\u00e7t\u0131.<\/p>\n<p>Taraflar\u0131 dinleyen mahkeme, i\u015fverenin performans d\u00fc\u015f\u00fckl\u00fc\u011f\u00fcne dair uyar\u0131 ve savunma taleplerini i\u00e7eren tutanaklar\u0131 imzalamayan i\u015f\u00e7inin tazminats\u0131z olarak kap\u0131 \u00f6n\u00fcne konulmas\u0131na onay verdi. Davac\u0131 i\u015f\u00e7i karar\u0131 temyiz edince devreye Yarg\u0131tay 9. Hukuk Dairesi girdi. Daval\u0131 i\u015fverenin, d\u00fc\u015f\u00fck performans sebebiyle savunmas\u0131n\u0131n istendi\u011fini, savunma vermedi\u011fini ve veriminin d\u00fc\u015fmesi sebebiyle i\u015f s\u00f6zle\u015fmesinin feshedildi\u011fini savundu\u011funa dikkat \u00e7eken Daire, &#8220;\u0130\u015f yeri disiplin kurulu karar\u0131nda hammadde ve malzemeyi zayi etmek su\u00e7undan feshedildi\u011fi yaz\u0131l\u0131d\u0131r. Daval\u0131 i\u015fveren davac\u0131n\u0131n hammadde ve malzemeye zarar verdi\u011fini ispat edememi\u015ftir. Cevap dilek\u00e7esinde s\u00f6z\u00fc edilen hususlarda sadece performansa dayal\u0131 belge sunulmu\u015ftur. \u0130\u015f\u00e7inin d\u00fc\u015f\u00fck performans g\u00f6stermesi ge\u00e7erli fesih nedeni olabilirse de \u0130\u015f Kanunu&#8217;nun 25. maddesinde d\u00fczenlenen hakl\u0131 fesih nedenleri aras\u0131nda i\u015f\u00e7inin performans d\u00fc\u015f\u00fckl\u00fc\u011f\u00fc yer almamaktad\u0131r. B\u00f6yle olunca davac\u0131n\u0131n ihbar ve k\u0131dem tazminat\u0131 isteklerinin kabul\u00fc gerekirken yaz\u0131l\u0131 \u015fekilde isteklerin reddi hatal\u0131 olup bozmay\u0131 gerektirmi\u015ftir.&#8221; gerek\u00e7esiyle Kayseri 2. \u0130\u015f Mahkemesi&#8217;nin karar\u0131n\u0131 bozdu. Yeniden yap\u0131lan yarg\u0131lama sonunda mahkeme, \u00f6nceki kararda direnince bu kez devreye Yarg\u0131tay Hukuk Genel Kurulu girdi.<\/p>\n<h3>Tazminats\u0131z at\u0131lamaz<\/h3>\n<p>Genel Kurul, i\u015fverenin, davac\u0131n\u0131n i\u015f yerindeki tav\u0131rlar\u0131, \u00e7al\u0131\u015fma verimini d\u00fc\u015f\u00fcrmesi, kendisine verilen uyar\u0131 ve savunmalar\u0131 imzalamay\u0131 reddederek i\u015fverenin y\u00f6netim yetkisini tan\u0131mamas\u0131 sebebiyle i\u015f s\u00f6zle\u015fmesinin disiplin kurulu karar\u0131 ile hakl\u0131 sebeple feshedildi\u011fini savundu\u011funa dikkat \u00e7ekti. Bu sebeple davac\u0131n\u0131n k\u0131dem ve ihbar tazminatlar\u0131na hak kazanamayaca\u011f\u0131n\u0131 bildirerek davan\u0131n reddini savundu\u011fu hat\u0131rlat\u0131ld\u0131. Mahkemece dinlenen daval\u0131 tan\u0131klar\u0131 beyanlar\u0131nda, davac\u0131n\u0131n ortalama g\u00fcnde 500 adet \u00e7elik delik delmekte iken ba\u015fka bir i\u015fyerinden teklif ald\u0131\u011f\u0131n\u0131 belirttikten sonra g\u00fcnl\u00fck 240 adet delik deldi\u011fini beyan ettiklerine vurgu yap\u0131ld\u0131.<br \/>\nYarg\u0131tay Hukuk Genel Kurulu karar\u0131nda \u015fu ifadelere yer verildi: &#8220;\u0130\u015f s\u00f6zle\u015fmesinin feshine neden olarak g\u00f6sterilen d\u00fc\u015f\u00fck performans g\u00f6sterme 4857 Say\u0131l\u0131 \u0130\u015f Kanununun 18. maddesinde d\u00fczenlenen ge\u00e7erli fesih nedenidir. Performans d\u00fc\u015f\u00fckl\u00fc\u011f\u00fc hakl\u0131 fesih nedeni olu\u015fturacak a\u011f\u0131rl\u0131kta olmamakla birlikte i\u015fyerinin normal i\u015fleyi\u015fini bozan, i\u015f g\u00f6rme borcunun gerektirdi\u011fi \u015fekilde yerine getirilmesini engelleyen hallerden olup ge\u00e7erli fesih nedeni olu\u015fturdu\u011fundan ve bu fesih \u015fekli de i\u015f\u00e7inin k\u0131dem ve ihbar tazminatlar\u0131na hak kazanmas\u0131na engel te\u015fkil etmez. Davac\u0131n\u0131n k\u0131dem ve ihbar tazminat\u0131 taleplerinin kabul\u00fc gerekirken reddine karar verilmesi hatal\u0131d\u0131r. \u0130\u015f\u00e7i g\u00f6revini uyar\u0131ya ra\u011fmen hi\u00e7 yerine getirmezse i\u015fveren hakl\u0131 sebeple derhal; eksik, k\u00f6t\u00fc, yetersiz bir bi\u00e7imde yerine getirirse ge\u00e7erli fesih hakk\u0131n\u0131 kullanabilecektir. Dosya kapsam\u0131nda yer alan tutanaklardan da anla\u015f\u0131ld\u0131\u011f\u0131 \u00fczere davac\u0131n\u0131n i\u015f g\u00f6rme borcunu hi\u00e7 yerine getirmemi\u015f olmas\u0131ndan de\u011fil eksik ve k\u00f6t\u00fc ifa etti\u011finden bahsedilmektedir.
