\u00c7oklu baro teklifinin komisyon g\u00f6r\u00fc\u015fmelerinde 12 madde daha kabul edildi.<\/h2>\n\n\n\n

TBMM Adalet Komisyonunda, d\u00fcn k\u00fc g\u00f6r\u00fc\u015fmelerde AK Parti ve MHP milletvekillerinin imzas\u0131n\u0131 ta\u015f\u0131yan Avukatl\u0131k Kanunu ile Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun Teklifi\u2019nin 5 maddesi kabul edilmi\u015fti. <\/p>\n\n\n\n

Sonras\u0131nda 12 madde daha kabul edilmesiyle toplamda 17 madde komisyondan ge\u00e7mi\u015f oldu.<\/p>\n\n\n\n

Kabul edilen maddelere g\u00f6re, ayn\u0131 ilde birden fazla baronun bulunmas\u0131 durumunda ayn\u0131 b\u00fcroda \u00e7al\u0131\u015fma ve avukatl\u0131k ortakl\u0131\u011f\u0131 kurmak i\u00e7in ayn\u0131 baroya kay\u0131tl\u0131 olma \u015fart\u0131 aranm\u0131yor.<\/p>\n\n\n\n

\u00a0\u201cAvukatl\u0131k ortakl\u0131\u011f\u0131\u201d, ayn\u0131 ilde kurulu barolardan herhangi birine kay\u0131tl\u0131 birden \u00e7ok avukat t\u00fczel ki\u015filik olarak tan\u0131mlanacak.<\/p>\n\n\n\n

Avukatlar, T\u00fcrkiye Barolar Birli\u011fi (TBB) taraf\u0131ndan \u015fekli belirlenen c\u00fcbbeyle mahkemelere \u00e7\u0131kacak. Avukatlara k\u0131l\u0131k ve k\u0131yafetle ilgili ba\u015fkaca bir zorunluluk getirilemeyecek.<\/p>\n\n\n\n

Ayn\u0131 ilde birden fazla baronun bulunmas\u0131 halinde adalet dairelerinde barolara ayr\u0131lacak yer, TBB\u2019ye tahsis edilecek. Birlik bu yeri, kay\u0131tl\u0131 avukat say\u0131s\u0131n\u0131 dikkate alarak, barolara tahsis edecek.<\/p>\n\n\n\n

Avukat yaz\u0131haneleri ve konutlar\u0131 ancak mahkeme karar\u0131yla ve kararda belirtilen olayla ilgili olarak Cumhuriyet savc\u0131s\u0131 denetiminde ve kay\u0131tl\u0131 olunan baro temsilcisinin kat\u0131l\u0131m\u0131 ile aranabilecek.<\/p>\n\n\n\n

Avukatlar\u0131n, avukatl\u0131k ile TBB ya da barolar\u0131n organlar\u0131ndaki g\u00f6revlerinden do\u011fan veya g\u00f6rev s\u0131ras\u0131nda i\u015fledikleri su\u00e7lar nedeniyle verilen b\u00f6lge adliye mahkemesi ceza dairelerinin kararlar\u0131na temyiz yolu a\u00e7\u0131lacak. Bu kapsamda ilk derece mahkemelerinden verilen 5 y\u0131l veya daha az hapis cezalar\u0131 ile miktar\u0131 ne olursa olsun adli para cezalar\u0131na kar\u015f\u0131 istinaf ba\u015fvurusunun esastan reddine dair b\u00f6lge adliye mahkemesi kararlar\u0131 da temyiz edilebilecek.<\/p>\n\n\n\n

Denetleme ve \u015fikayetle ilgili meselelerde avukat, meslek s\u0131rr\u0131n\u0131 saklama y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcne ayk\u0131r\u0131 d\u00fc\u015fmedik\u00e7e, kay\u0131tl\u0131 oldu\u011fu baro ba\u015fkan\u0131na veya y\u00f6netim kuruluna, bunlar taraf\u0131ndan g\u00f6revlendirilen \u00fcyelerden birine bilgi vermek ve istek \u00fczerine dosyalar\u0131 g\u00f6ndermek, dinlenmek \u00fczere \u00e7a\u011f\u0131r\u0131ld\u0131\u011f\u0131 hallerde baro ba\u015fkan\u0131, y\u00f6netim kurulu veya bu kurul \u00fcyelerinden birinin davetine uymak zorunda olacak.<\/p>\n\n\n\n

Yaz\u0131l\u0131 zorunlu\u011fa uymayan avukat hakk\u0131nda, kay\u0131tl\u0131 oldu\u011fu baro y\u00f6netim kurulu, 10 bin liradan 100 bin liraya kadar para cezas\u0131 verebilecek. Bu para cezas\u0131na, tebli\u011finden itibaren 15 g\u00fcn i\u00e7inde, karar\u0131 veren baronun disiplin kuruluna itiraz edilebilecek.<\/p>\n\n\n\n

Mesle\u011fe yeni ba\u015flayan avukatlar\u0131n baro kesene\u011fi, 5 y\u0131l s\u00fcreyle yar\u0131 oran\u0131nda al\u0131nacak.<\/p>\n\n\n\n

Bir avukat, levhas\u0131nda yaz\u0131l\u0131 bulundu\u011fu baro b\u00f6lgesi d\u0131\u015f\u0131nda s\u00fcrekli olarak avukatl\u0131k yapar veya disiplin cezas\u0131 gerektiren bir eylemde bulunursa, bu tespiti yapan baronun y\u00f6netim kurulu taraf\u0131ndan bu konuda d\u00fczenlenecek tutanak, gereken i\u015flem yap\u0131lmak \u00fczere avukat\u0131n levhas\u0131nda yaz\u0131l\u0131 oldu\u011fu baroya g\u00f6nderilecek.<\/p>\n\n\n\n

5 binden fazla avukat bulunan illerde asgari 2 bin avukatla bir baro kurulabilecek.<\/p>\n\n\n\n

Kurulu\u015f m\u00fcracaat\u0131nda, kurulu\u015f talebini i\u00e7eren dilek\u00e7e ile 2 bin avukat\u0131n imzas\u0131n\u0131n ve bu avukatlar\u0131n belirledi\u011fi 4 ki\u015filik kurucular kurulunun isimlerinin yer ald\u0131\u011f\u0131 liste TBB\u2019ye verilecek. Birlik, kurulu\u015f i\u015flemlerini yerine getirmek \u00fczere kurucular kurulunu g\u00f6revlendirecek. Kurucular kurulu en ge\u00e7 6 ay i\u00e7inde yeni baronun kurulu\u015funu tamamlayacak ve TBB\u2019ye bildirecek.<\/p>\n\n\n\n

Avukat say\u0131s\u0131n\u0131n 2 binin alt\u0131na d\u00fc\u015fmesi halinde TBB, barodan asgari avukat say\u0131s\u0131n\u0131n 6 ay i\u00e7inde sa\u011flanmas\u0131n\u0131 yaz\u0131l\u0131 olarak isteyecek. Verilen s\u00fcre i\u00e7inde eksiklik giderilemezse TBB, baronun t\u00fczel ki\u015fili\u011fine son verecek ve son verme karar\u0131 TBB\u2019nin resmi internet sitesinde ilan edilecek.<\/p>\n\n\n\n

T\u00fczel ki\u015fili\u011fi sona eren baroya kay\u0131tl\u0131 avukatlar ve stajyerler ilan tarihinden itibaren 15 g\u00fcn i\u00e7inde o ilde bir baro varsa o baroya, birden fazla baro varsa diledikleri baroya kaydolacak ve bunlar\u0131n devam eden i\u015f ve i\u015flemleri kaydolduklar\u0131 baro taraf\u0131ndan y\u00fcr\u00fct\u00fclecek. T\u00fczel ki\u015fili\u011fi sona eren baronun tasfiye i\u015flemleri son y\u00f6netim kurulu taraf\u0131ndan birli\u011fin denetim ve g\u00f6zetiminde yap\u0131lacak ve kalan mal varl\u0131\u011f\u0131 TBB\u2019ye ge\u00e7ecek.<\/p>\n\n\n\n

Ayn\u0131 ilde yeni bir baronun kurulmas\u0131 halinde TBB, t\u00fczel ki\u015filik kazanma tarihini esas almak ve birden ba\u015flamak suretiyle barolar\u0131 o ilin ad\u0131yla numaraland\u0131racak.<\/p>\n\n\n\n

Teklifle, t\u00fcm il barolar\u0131n\u0131n genel kurullar\u0131n\u0131n, barolar\u0131n kurulu\u015f tarihine bak\u0131lmaks\u0131z\u0131n, belirli bir d\u00fczen i\u00e7inde ve ayn\u0131 tarihlerde yap\u0131lmas\u0131 ama\u00e7lan\u0131yor. Buna g\u00f6re, t\u00fcm baro genel kurullar\u0131 son rakam\u0131 \u00e7ift olan y\u0131llarda olmak \u015fart\u0131yla iki y\u0131lda bir ekim ay\u0131n\u0131n ilk haftas\u0131 i\u00e7inde yap\u0131lacak.<\/p>\n\n\n\n

Se\u00e7im d\u00f6neminin bitmesinden \u00f6nce ayr\u0131lan baro ba\u015fkan\u0131n\u0131n yerine baro y\u00f6netim kurulu taraf\u0131ndan, kendi \u00fcyeleri aras\u0131ndan, kalan s\u00fcreyi tamamlamak \u00fczere baro ba\u015fkan\u0131 se\u00e7ilecek.<\/p>\n\n\n\n

Barolara ili\u015fkin 28 maddeden olu\u015fan kanun teklifinin 17. maddesinin kabul\u00fcn\u00fcn ard\u0131ndan TBMM Adalet Komisyonu Ba\u015fkanvekili ve AK Parti Bart\u0131n Milletvekili Y\u0131lmaz Tun\u00e7, toplant\u0131y\u0131, teklifin di\u011fer maddelerinin g\u00f6r\u00fc\u015fmeleri i\u00e7in bug\u00fcn saat 14.00\u2019te toplanmak \u00fczere kapatt\u0131.<\/p>\n\n\n\n
