A\u00e7\u0131klaman\u0131n tam metni \u015f\u00f6yle; <\/p>\n\n\n\n<p>UGC-Uluslararas\u0131 Gazeteciler Cemiyeti \u201c Dezenformasyon Yasas\u0131n\u0131n 29.Maddesi Gazeteciler Ad\u0131na Kabul Edilemez<\/p>\n\n\n\n<p>&#8220;UGC-Uluslararas\u0131 Gazeteciler Cemiyeti &#8216;Dezenformasyon Yasas\u0131n\u0131n 29.Maddesi Gazeteciler Ad\u0131na Kabul Edilemez&#8217;<br \/>&#8216;Dezenformasyonla m\u00fccadele d\u00fczenlemesi&#8217; olarak bilinen Bas\u0131n Kanunu ile Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun Teklifi, TBMM Genel Kurulunda kabul edilerek yasala\u015ft\u0131.<\/p>\n\n\n\n<p>Bu yasa \u00f6zellikle internet haber sitelerinin s\u00fcreli yay\u0131n stat\u00fcs\u00fcne al\u0131nmas\u0131 ve haber sitelerine resmi ilan ve reklam verilmesi, haber sitesi \u00e7al\u0131\u015fanlar\u0131na bas\u0131n kart\u0131 d\u00fczenlenmesi, \u00e7e\u015fitli bas\u0131n kartlar\u0131n\u0131n tan\u0131m\u0131m\u0131n yap\u0131lmas\u0131 ve kriterlerinin belirlenmesi, \u00e7ocuklar\u0131n k\u00f6t\u00fc i\u00e7eriklerden korunmas\u0131 gibi konularda \u00e7ok gerekli ve \u00f6nemli de\u011fi\u015fiklikler i\u00e7eriyor.<\/p>\n\n\n\n<p>Ama 40 maddeden olu\u015fan bu d\u00fczenlemenin 29. maddesi b\u00fct\u00fcn bu yap\u0131lmaya \u00e7al\u0131\u015fan iyi d\u00fczenlemelere g\u00f6lge d\u00fc\u015f\u00fcrmektedir. 26\/9\/2004 tarihli ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanununa 217 nci maddesinden sonra gelmek \u00fczere eklenen &#8216;Halk\u0131 yan\u0131lt\u0131c\u0131 bilgiyi alenen yayma&#8217; ibaresi ve bu ibareyi a\u00e7\u0131klayan &#8216;S\u0131rf halk aras\u0131nda endi\u015fe, korku veya panik yaratmak saikiyle, \u00fclkenin i\u00e7 ve d\u0131\u015f g\u00fcvenli\u011fi, kamu d\u00fczeni ve genel sa\u011fl\u0131\u011f\u0131 ile ilgili ger\u00e7e\u011fe ayk\u0131r\u0131 bir bilgiyi, kamu bar\u0131\u015f\u0131n\u0131 bozmaya elveri\u015fli \u015fekilde alenen yayan kimse, bir y\u0131ldan \u00fc\u00e7 y\u0131la kadar hapis cezas\u0131yla cezaland\u0131r\u0131l\u0131r.\u201d&#8217; 217. maddesinin A f\u0131kras\u0131 bu getirilmeye \u00e7al\u0131\u015f\u0131lan d\u00fczenlemeye g\u00f6lge d\u00fc\u015f\u00fcrmektedir.<\/p>\n\n\n\n<p>Bu ifadede ge\u00e7en &#8216;\u00dclkenin i\u00e7 ve d\u0131\u015f g\u00fcvenli\u011fi, kamu d\u00fczeni ve genel sa\u011fl\u0131\u011f\u0131 ile ilgili ger\u00e7e\u011fe ayk\u0131r\u0131 bir bilgi&#8217; tan\u0131mlamas\u0131 pek \u00e7ok avukat, uzman, emekli hakim ve gazeteci taraf\u0131ndan da ifade edildi\u011fi \u00fczere mu\u011flakt\u0131r. B\u00f6yle mu\u011flak ifadeler \u00fczerinden belirlenen cezalar t\u00fcm kamuoyu taraf\u0131ndan endi\u015fe ile kar\u015f\u0131lanm\u0131\u015ft\u0131r. T\u00fcm gazeteciler ve toplum ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn k\u0131s\u0131tlanaca\u011f\u0131 konusunda endi\u015felidir ve hapis cezas\u0131 ile sonu\u00e7lanabilecek olan bu eylem t\u00fcm halk\u0131 oto sans\u00fcre g\u00f6t\u00fcrecektir.<\/p>\n\n\n\n<p>Ayr\u0131ca, bu yasal d\u00fczenlemeler Uluslararas\u0131 Gazeteciler Cemiyeti de dahil olmak \u00fczere hi\u00e7bir gazetecilik \u00f6rg\u00fct\u00fc ile g\u00f6r\u00fc\u015f\u00fclmeden haz\u0131rlanm\u0131\u015ft\u0131r. Ba\u015fta gazetecileri ve daha sonra sosyal medya kullan\u0131c\u0131lar\u0131n\u0131 ilgilendiren bu d\u00fczenlemenin gazeteci \u00f6rg\u00fctlerinin g\u00f6r\u00fc\u015f\u00fc al\u0131nmadan haz\u0131rlanmas\u0131 sans\u00fcrle ilgili ba\u015fka ku\u015fkular\u0131 da uyand\u0131rmaktad\u0131r. \u00d6zellikle se\u00e7im sath\u0131na girdi\u011fimiz bu d\u00f6nemde, bu yasan\u0131n meclisten ge\u00e7mesi, korkulan d\u00fczeyde uygulanmasa bile pek \u00e7ok insan\u0131n \u00f6zg\u00fcrce fikirlerini ifade edememesine yol a\u00e7acakt\u0131r.<\/p>\n\n\n\n<p>UGC-Uluslararas\u0131 Gazeteciler Cemiyeti olarak bu d\u00fczenlemeyi k\u0131n\u0131yoruz, \u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn T\u00fcrkiye\u2019de yara almadan devam edebilmesi i\u00e7in hapis cezas\u0131yla sonu\u00e7lanan Dezenformasyon Yasas\u0131n\u0131n 29.
