Dan\u0131\u015ftay 8. Daire, ara\u00e7lar\u0131n kalk\u0131\u015f yerlerini, ara durak ve bindirme ceplerini belirleme yetkisini b\u00fcy\u00fck\u015fehirlerden al\u0131p il m\u00fclki idarelerine veren y\u00f6netmelik de\u011fi\u015fikli\u011fini iptal etti. Kararda, kanunla belediyelere verilen yetkinin y\u00f6netmelik ile belediyenin yetkili karar mercilerinden al\u0131narak do\u011frudan m\u00fclki idare amiri yetkisine b\u0131rak\u0131lamayaca\u011f\u0131 vurguland\u0131. Karar bu y\u00f6n\u00fcyle, UKOME&#8217;nin yap\u0131s\u0131n\u0131 de\u011fi\u015ftiren y\u00f6netmelik davas\u0131 i\u00e7in de emsal te\u015fkil ediyor.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>5216 say\u0131l\u0131 B\u00fcy\u00fck\u015fehir Belediyesi Kanunu; \u201cb\u00fcy\u00fck\u015fehirlerde ula\u015f\u0131m hizmetlerini planlamak; y\u00fcr\u00fctmek, kurmak, kurdurmak, i\u015fletmek, i\u015flettirmek ve toplu ta\u015f\u0131ma ara\u00e7lar\u0131na ruhsat vermek\u201d yetkilerini B\u00fcy\u00fck\u015fehir Belediyelerine veriyor. \u0130stanbul B\u00fcy\u00fck\u015fehir Belediyesi (\u0130BB), bu yetki ile hem ula\u015f\u0131m\u0131n kent \u00e7er\u00e7evesinde etkin ve verimli planlamas\u0131n\u0131 yap\u0131yor, hem de kamu ad\u0131na gelir elde ederek toplu ula\u015f\u0131m hizmetinin en kaliteli ve sa\u011fl\u0131kl\u0131 \u015fekilde sunulmas\u0131na \u00f6nc\u00fcl\u00fck ediyor.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Ancak, Ula\u015ft\u0131rma ve Altyap\u0131 Bakanl\u0131\u011f\u0131 2020 y\u0131l\u0131nda Karayolu Ta\u015f\u0131ma Y\u00f6netmeli\u011finde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Y\u00f6netmelikte yapt\u0131\u011f\u0131 de\u011fi\u015fik yaparak \u201cHavaliman\u0131ndan \u015fehir merkezine, ba\u015fka bir \u015fehir veya tersi y\u00f6ne ta\u015f\u0131ma yapacak B1 ve D1 yetki belgesi sahibi olan ve havaliman\u0131 i\u015fleticisi ile yer tahsis s\u00f6zle\u015fmesi imzalam\u0131\u015f olanlar i\u00e7in, yap\u0131lacak ta\u015f\u0131man\u0131n ger\u00e7ekle\u015fece\u011fi ta\u015f\u0131ma hatt\u0131ndaki kalk\u0131\u015f yeri\/noktas\u0131, ara durak, indirme\/bindirme cepleri ve var\u0131\u015f yeri\/noktalar\u0131, faaliyet yap\u0131lacak il\/illerin m\u00fclki idare amirlerinin izni ile belirlenir ve bu nokta\/yerler i\u00e7in, bu maddenin on ikinci f\u0131kras\u0131nda belirtilen zorunluluk ve 58 inci maddenin birinci f\u0131kras\u0131n\u0131n (a) bendindeki zorunluluk ile ayakta yolcu ta\u015f\u0131nmamas\u0131 \u015fart\u0131yla 36 nc\u0131 maddenin birinci ve ikinci f\u0131kralar\u0131 hari\u00e7 di\u011fer f\u0131kralar\u0131nda belirlenmi\u015f y\u00fck\u00fcml\u00fcl\u00fckler aranmaz\u201d h\u00fckm\u00fcn\u00fc getirdi. Bakanl\u0131k, de\u011fi\u015fiklikle birlikte bu alanlarla ilgili yetkiyi il m\u00fclki idarelerine verdi.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><strong>\u0130BB y\u00f6netmeli\u011fi yarg\u0131ya ta\u015f\u0131d\u0131<\/strong><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>\u0130BB, ilgili karar\u0131n 5216 say\u0131l\u0131 B\u00fcy\u00fck\u015fehir Belediyesi Kanuna ve il m\u00fclki idarelerine verilen yetkinin b\u00fcy\u00fck\u015fehir belediyeleri koordinasyon merkezleri y\u00f6netmeli\u011fi h\u00fck\u00fcmleri ile belirlenmesi gereklili\u011fi nedeniyle d\u00fczenlemenin iptalini istedi.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Davay\u0131 g\u00f6ren Dan\u0131\u015ftay 8. Dairesi, \u0130BB\u2019yi hakl\u0131 bularak Resmi Gazete\u2019de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe giren d\u00fczenlemeyi iptal etti. Mahkeme, Karayolu Ta\u015f\u0131ma Y\u00f6netmeli\u011finde De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Y\u00f6netmelik\u2019in 4. f\u0131kras\u0131 ile, esas Y\u00f6netmeli\u011fin 41. maddesine eklenen 16. f\u0131kras\u0131n\u0131n \u201c\u2026.Yap\u0131lacak ta\u015f\u0131man\u0131n ger\u00e7ekle\u015fece\u011fi ta\u015f\u0131ma hatt\u0131ndaki kalk\u0131\u015f yeri\/noktas\u0131, ara durak, indirme\/bindirme cepleri ve var\u0131\u015f yeri\/noktalar\u0131, faaliyet yap\u0131lacak il\/illerin m\u00fclki idare amirlerinin izni ile belirlenir ve bu nokta\/yerler i\u00e7in, bu maddenin on ikinci f\u0131kras\u0131nda belirtilen zorunluluk ve 58 nci maddenin birinci f\u0131kras\u0131n\u0131n a bendindeki zorunluluk ile \u2026\u201d ibaresini hukuka uygun bulmayarak iptaline h\u00fckmetti.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>Dava konusu y\u00f6netmelik maddesinin \u201c\u2026ta\u015f\u0131ma hatt\u0131ndaki kalk\u0131\u015f yeri\/noktas\u0131, ara durak, indirme\/bindirme cepleri ve var\u0131\u015f yeri\/noktalar\u0131n\u0131n faaliyet yap\u0131lacak il\/illerin m\u00fclki idare amirlerinin izni ile belirlenir\u2026\u201d ibaresi ile dava konusu madde de ge\u00e7en &#8220;\u2026bu nokta\/yerler i\u00e7in, bu maddenin onikinci f\u0131kras\u0131nda belirtilen zorunluluk\u2026 aranmaz &#8221; ibareleri de yine hukuka uygun bulunmayarak iptaline karar verildi. Y\u00f6netmelik maddesinde ge\u00e7en &#8220;\u2026ve 58 inci maddenin birinci f\u0131kras\u0131n\u0131n (a) bendindeki zorunluluk\u2026. aranmaz&#8221; ibaresi de iptal edildi.<\/p>\n\n\n\n<p><br \/><strong>Emsal niteli\u011finde<\/strong><\/p>\n\n\n\n<p><br \/>Dan\u0131\u015ftay karar\u0131nda, kanunla belediyelere verilen yetkinin y\u00f6netmelik ile belediyenin yetkili karar mercilerinden al\u0131narak do\u011frudan m\u00fclki idare amiri yetkisine b\u0131rak\u0131lmas\u0131n\u0131n hukuka ayk\u0131r\u0131l\u0131\u011f\u0131na vurgu yap\u0131ld\u0131.
