Akdeniz Roman Dernekleri Federasyonu Ba\u015fkan\u0131 Ali Daylam bu proje i\u00e7in; \u201cBir kentsel d\u00f6n\u00fc\u015f\u00fcm projesi de\u011fil Romanlar i\u00e7in geri d\u00f6n\u00fc\u015f\u00fc olmayan bir felaket olur.\u201d a\u00e7\u0131klamas\u0131nda bulunmu\u015ftu.<\/p>\n\n\n\n<p>\u0130tirazlar\u0131n reddedilmesinin ard\u0131ndan ba\u015fta Akdeniz Roman Dernekleri Federasyonu Ba\u015fkan\u0131 Ali Daylam olmak \u00fczere mahallede ya\u015fayan ve hak sahibi baz\u0131 Romanlar Avrupa Roman Haklar\u0131 Merkezi\u2019nin destekleriyle karar\u0131n iptali i\u00e7in dava a\u00e7m\u0131\u015f ve bu davalar\u0131n avukatl\u0131\u011f\u0131n\u0131 da Mersin baro ba\u015fkanl\u0131\u011f\u0131 yapm\u0131\u015f Avukat Bilgin Ye\u015filbo\u011faz \u00fcstlenmi\u015fti.<\/p>\n\n\n\n<p><strong>Dava konusu <\/strong><strong><\/strong><\/p>\n\n\n\n<p>S\u00f6z konusu dava, riskli alan olarak se\u00e7ilen alan\u0131n neye g\u00f6re se\u00e7ildi\u011fi ve se\u00e7ilen alan\u0131n mek\u00e2nsal planlar y\u00f6netmeli\u011fine ayk\u0131r\u0131l\u0131k ta\u015f\u0131d\u0131\u011f\u0131, riskli alan\u0131n belirlenmesinde Akdeniz Belediyesi taraf\u0131ndan\u00a0 haz\u0131rlanan raporun hangi bilimsel temellere g\u00f6re haz\u0131rland\u0131\u011f\u0131n\u0131n eksik oldu\u011fu ve binalar\u0131n yap\u0131 durumunun net olmad\u0131\u011f\u0131, riskli olarak ilan edilen s\u00fcre\u00e7te katot analizi yap\u0131lmad\u0131\u011f\u0131 ve ba\u015fka herhangi \u00f6zel veya kamu kurumundan risk ve yap\u0131 duruma\u00a0 dair her hangi kesin bir yarg\u0131 i\u00e7eren bilimsel veya teknik bir rapor al\u0131nmad\u0131\u011f\u0131, plan alan\u0131nda kalan ruhsats\u0131z (imar bar\u0131\u015f\u0131 ile hak kazanm\u0131\u015f) ve ruhsatl\u0131 yap\u0131lar\u0131n proje kapsam\u0131na ve hak sahipli\u011fi \/ hak edi\u015f\u00a0 olarak nas\u0131l ele al\u0131naca\u011f\u0131n\u0131n a\u00e7\u0131klanmad\u0131\u011f\u0131, imar plan\u0131 de\u011fi\u015fikli\u011finin \u00f6ng\u00f6r\u00fcld\u00fc\u011f\u00fc alanda ya\u015fayan insanlar\u0131n sosyodemografik yap\u0131s\u0131yla ilgili bir \u00e7al\u0131\u015fma yap\u0131lmad\u0131\u011f\u0131 ve proje alan\u0131nda ya\u015fayanlar\u0131n b\u00fcy\u00fck bir k\u0131sm\u0131n\u0131n Romanlar oldu\u011fu ve bu \u00e7al\u0131\u015fma yap\u0131l\u0131rken Romanlar\u0131n alandaki varl\u0131\u011f\u0131, ekonomik ko\u015fullar\u0131 ve faaliyetlerinin dikkate al\u0131nmad\u0131\u011f\u0131, s\u00f6z konusu alanda yap\u0131lmas\u0131 \u00f6ng\u00f6r\u00fclen onays\u0131z projenin tasar\u0131m\u0131nda alanda ya\u015fayanlar\u0131n sosyok\u00fclt\u00fcrel yap\u0131s\u0131na ait bir \u00e7al\u0131\u015fma yap\u0131lmad\u0131\u011f\u0131 ve klasik bir toplu konut projesi yap\u0131lmas\u0131 planland\u0131\u011f\u0131n\u0131n d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fc, \u00f6ng\u00f6r\u00fclen projenin finansman modelinin a\u00e7\u0131klanmad\u0131\u011f\u0131 ve\u00a0 alanda ya\u015fayan m\u00fclk sahiplerinin ma\u011fduriyetlerinin nas\u0131l \u00f6nlenece\u011fi, bor\u00e7land\u0131rma yap\u0131l\u0131p yap\u0131lmayaca\u011f\u0131 gibi konular\u0131n belirsiz oldu\u011fu, mevcut durumda 172 hak sahibi bulunurken planlanan projede bu 172 hak sahibine ilaveten 305 yap\u0131da yeni hak sahiplerinin olu\u015faca\u011f\u0131, bu alanda 100 y\u0131ld\u0131r Romanlar\u0131n ya\u015fad\u0131\u011f\u0131 ve planlanan proje sonucunda alanda bir sosyal d\u00f6n\u00fc\u015f\u00fcm\u00fcn ba\u015flayaca\u011f\u0131ndan endi\u015fe edildi\u011fi ve bu sebeple s\u00f6z konusu imar planlar\u0131n\u0131n eklerine Sosyal Etki De\u011ferlendirme Raporu\/Analizi eklenmesi gerekti\u011fi temelinde a\u00e7\u0131lm\u0131\u015ft\u0131.\u00a0 \u00a0\u00a0\u00a0\u00a0\u00a0<\/p>\n\n\n\n<p><strong>Bilirki\u015fi raporu Romanlardan yana karar verdi<\/strong><strong><\/strong><\/p>\n\n\n\n<p>A\u00e7\u0131lan dava ile ilgili olarak mahkeme heyeti iddialar\u0131n do\u011fru olup olmad\u0131\u011f\u0131n\u0131n ara\u015ft\u0131r\u0131lmas\u0131 i\u00e7in bir bilirki\u015fi raporunun haz\u0131rlanmas\u0131 konusunda karar vermi\u015fti.\u00a0 Bilirki\u015filerin s\u00f6z konusu iddialar hakk\u0131nda yapt\u0131\u011f\u0131 incelemeler ve tespitleri sonucunda \u00a0verdi\u011fi kararda, \u201cMersin ili, Akdeniz il\u00e7esi, Turgutreis Mahallesi, 710 ada 99 parsel say\u0131l\u0131 ta\u015f\u0131nmazlar\u0131 kapsayan alanda yap\u0131lan 1\/1000 \u00f6l\u00e7ekli uygulama imar plan\u0131 ile 1\/5000 \u00f6l\u00e7ekli naz\u0131m imar plan\u0131 de\u011fi\u015fikliklerinin plan kademesine uygun, ancak planlama ve \u015fehircilik esaslar\u0131na uygun olmad\u0131\u011f\u0131 g\u00f6r\u00fc\u015f\u00fcne ula\u015f\u0131lm\u0131\u015ft\u0131r.\u201d denildi. \u00a0\u00a0<\/p>\n\n\n\n<p>Akdeniz Roman Dernekleri Federasyonu Ba\u015fkan\u0131 Ali Daylam bu projenin bir felaket olaca\u011f\u0131n\u0131 daha \u00f6nceden s\u00f6ylediklerini belirterek; &#8220;Haz\u0131rlanan bilirki\u015fi raporu da bizi bu konuda onaylad\u0131. Biz bu yanl\u0131\u015ftan bir an \u00f6nce d\u00f6n\u00fclmesini istiyoruz yoksa Mersin&#8217;de zaten yok olmakta olan Roman k\u00fclt\u00fcr\u00fc tamamen ortadan kalkacak. Biz Mersin Romanlar\u0131 olarak  Turgutreis&#8217;te hem Romanlar\u0131n k\u00fclt\u00fcr ve ya\u015fam tarz\u0131na uyan hem de onlar\u0131 sosyo-ekonomik anlamda d\u00f6n\u00fc\u015ft\u00fcren \u00f6rnek bir kentsel d\u00f6n\u00fc\u015f\u00fcm projesi ba\u015flat\u0131lmas\u0131 i\u00e7in elimizden gelen her \u015feyi yapaca\u011f\u0131z.&#8221; dedi.
