Hukuk Dairesi, 11 Ekim 2024 tarihli karar\u0131nda TTB ve A\u011fr\u0131-Kars-Ardahan-I\u011fd\u0131r Tabip Odas\u0131\u2019n\u0131n feri m\u00fcdahillik ba\u015fvurusunu usuli a\u00e7\u0131dan reddetmekle birlikte; ba\u015fvurulardaki gerek\u00e7elere at\u0131fla tedbir talebinin reddine ili\u015fkin mahkeme karar\u0131n\u0131n kald\u0131r\u0131lmas\u0131na ve dosyan\u0131n ilk derece mahkemesine g\u00f6nderilmesine h\u00fckmetti.<\/p>\n\n\n\n<p>Oybirli\u011fi ile al\u0131nan karar\u0131n gerek\u00e7esinde \u015fu ifadelere yer verildi:<\/p>\n\n\n\n<p><em>\u201cSomut uyu\u015fmazl\u0131kta, mahkemece, duru\u015fma yap\u0131lmaks\u0131z\u0131n evrak \u00fczerinde yap\u0131lan inceleme ile karar verilmi\u015ftir. 6100 say\u0131l\u0131 Hukuk Muhakemeleri Kanunu\u2019nda bu istemlerin evrak \u00fczerinden karara ba\u011flanaca\u011f\u0131na ili\u015fkin \u00f6zel bir h\u00fck\u00fcm bulunmamaktad\u0131r. O halde mahkemece duru\u015fma a\u00e7\u0131lmas\u0131, talebin k\u00fc\u00e7\u00fc\u011f\u00fcn hak ve menfaatleriyle do\u011frudan ilgili oldu\u011fundan, veli veya velileri ya da vasisi ile taraf\u0131na 5395 say\u0131l\u0131 kanunun 7. maddesi ile y\u00fck\u00fcml\u00fcl\u00fck verilen ilgili Aile ve Sosyal Hizmetler \u0130l M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile ayn\u0131 kanunun 45\/1.d maddesi ile y\u00fck\u00fcml\u00fcl\u00fck verilen ilgili \u0130l Sa\u011fl\u0131k M\u00fcd\u00fcrl\u00fc\u011f\u00fc\u2019n\u00fcn duru\u015fmaya davet edilmesi, g\u00f6sterdikleri takdirde delilleri toplanarak t\u00fcm delillerin birlikte de\u011ferlendirilmesi ve ger\u00e7ekle\u015fecek sonucu uyar\u0131nca karar verilmesi gerekirken, y\u00f6ntemince taraf te\u015fkili sa\u011flanmaks\u0131z\u0131n, \u00e7ocu\u011fun yasal temsilcisinin ve ilgili kurumlar\u0131n hukuki dinlenilme hakk\u0131 (HMK m. 27) ihlal edilerek, soyut ve denetime elveri\u015fli olmaktan uzak gerek\u00e7elerle dosya \u00fczerinden inceleme yap\u0131larak yaz\u0131l\u0131 \u015fekilde h\u00fck\u00fcm kurulmas\u0131 do\u011fru g\u00f6r\u00fclmemi\u015ftir.\u201d<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>\u0130stinaf Mahkemesi, Kars Aile Mahkemesi\u2019nin \u00c7ocu\u011fun \u00dcst\u00fcn Yarar\u0131n\u0131 ve Halk Sa\u011fl\u0131\u011f\u0131n\u0131 Tehdit Eden Bilim D\u0131\u015f\u0131 Topuk Kan\u0131 Karar\u0131n\u0131n Kald\u0131r\u0131lmas\u0131na H\u00fckmetti.
