Anayasa Mahkemesi CHP’nin ba\u015fvurusu \u00fczerine noterlerin hafta sonu ve tatil g\u00fcnlerinde \u00e7al\u0131\u015fmas\u0131na olanak tan\u0131yan d\u00fczenlemeyi iptal etti.<\/h3>\n\n\n\n

Resmi Gazete<\/a>‘de yer alan karara g\u00f6re, noterler bundan sonra tatil g\u00fcnlerindeki mesai yapmayacak.<\/p>\n\n\n\n

CHP<\/a>, 7532 say\u0131l\u0131 Noterlik Kanunu<\/a> ve Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun’un baz\u0131 h\u00fck\u00fcmlerinin Anayasa’ya ayk\u0131r\u0131 oldu\u011funu ileri s\u00fcrerek iptali i\u00e7in AYM’ye ba\u015fvurmu\u015ftu. Y\u00fcksek Mahkeme, noterlerin tatil g\u00fcnlerinde \u00e7al\u0131\u015ft\u0131r\u0131lma usul\u00fcn\u00fc ve san\u0131\u011fa ula\u015f\u0131lamad\u0131\u011f\u0131 durumlarda sadece avukata yap\u0131lan tebligatla dava bitirilmesini \u00f6ng\u00f6ren maddeleri Anayasa’ya ayk\u0131r\u0131 bularak iptal etti.<\/p>\n\n\n\n

Anayasa Mahkemesi, 14 Kas\u0131m 2024 tarihli ve 7532 say\u0131l\u0131 “Noterlik Kanunu ile Baz\u0131 Kanunlarda De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun”un baz\u0131 kritik maddelerine kar\u015f\u0131 a\u00e7\u0131lan iptal davas\u0131nda nihai karar\u0131n\u0131 verdi. Mahkeme, adil yarg\u0131lanma hakk\u0131 ve \u00e7al\u0131\u015fanlar\u0131n dinlenme hakk\u0131 gibi temel anayasal s\u0131n\u0131rlar\u0131 \u00e7izerek iki \u00f6nemli d\u00fczenlemeyi iptal ederken, kamuda \u00e7al\u0131\u015fanlar\u0131n avukatl\u0131k staj\u0131 ve cezaevindeki e\u011fitim haklar\u0131 gibi d\u00fczenlemeleri ise Anayasa’ya uygun buldu.<\/p>\n\n\n\n

\u0130ptal edilen en dikkat \u00e7ekici maddelerden biri noterlerin tatil g\u00fcnlerindeki mesaileriyle ilgili oldu. Kanunla, noterlerin hafta sonu ve resmi tatillerde \u00e7al\u0131\u015fma usul ve esaslar\u0131n\u0131 belirleme yetkisi do\u011frudan Adalet Bakanl\u0131\u011f\u0131\u2019n\u0131n \u00e7\u0131karaca\u011f\u0131 bir y\u00f6netmeli\u011fe b\u0131rak\u0131lm\u0131\u015ft\u0131.<\/p>\n\n\n\n
