“Ter\u00f6rs\u00fcz T\u00fcrkiye” s\u00fcreci kapsam\u0131nda haz\u0131rlanan PKK ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn fesih s\u00fcreci ile ilgili kanun teklifi TBMM <\/a>Ba\u015fkanl\u0131\u011f\u0131na sunuldu. \u201cMilli Dayan\u0131\u015fma ve Toplumsal B\u00fct\u00fcnle\u015fmenin G\u00fc\u00e7lendirilmesine Dair Kanun Teklifi\u201d ad\u0131yla sunulan teklif 12 maddeden olu\u015fuyor.<\/p>\n\n\n\n

Zamana\u015f\u0131m\u0131 s\u00fcresi olmaks\u0131z\u0131n 15 y\u0131l\u0131n alt\u0131ndaki su\u00e7larda 5 y\u0131l, 15 y\u0131l\u0131n \u00fczerindeki su\u00e7larda ise 10 y\u0131l ceza ertelemesi \u00f6ng\u00f6r\u00fcl\u00fcyor<\/strong>.<\/p>\n\n\n\n

PKK\/KCK <\/a>ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn ve bununla ba\u011flant\u0131l\u0131 her t\u00fcrl\u00fc olu\u015fumun fiili varl\u0131\u011f\u0131na son verdi\u011finin ve kontrol\u00fc alt\u0131nda bulunan her t\u00fcrl\u00fc silah ve m\u00fchimmat\u0131 teslim etti\u011finin g\u00fcvenlik kurumlar\u0131nca tespiti ve bu tespitin teyidine dair Milli G\u00fcvenlik Kurulu Karar\u0131n\u0131n Resmi Gazete<\/a>‘de yay\u0131mlanmas\u0131n\u0131 m\u00fcteakip d\u00fczenleme, PKK\/KCK ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fc kurma veya y\u00f6netme, \u00f6rg\u00fcte \u00fcye olma veya bilerek ve isteyerek yard\u0131m etme ve \u00f6rg\u00fct\u00fcn propagandas\u0131n\u0131 yapma su\u00e7lar\u0131 ile bu \u00f6rg\u00fct\u00fcn faaliyeti kapsam\u0131nda i\u015flenen su\u00e7lar\u0131 ve bu \u00f6rg\u00fct lehine i\u015flenen Ter\u00f6rizmin Finansman\u0131n\u0131n \u00d6nlenmesi Hakk\u0131nda Kanunda d\u00fczenlenen su\u00e7lar\u0131 kapsayacak.<\/p>\n\n\n\n

PKK’ye \u00f6zel olarak d\u00fczenlenen teklifle, “\u00f6rg\u00fct kurma veya y\u00f6netme, \u00fcyelik, bilerek ve isteyerek yard\u0131m, propaganda, \u00f6rg\u00fct faaliyeti kapsam\u0131ndaki su\u00e7lar ve ter\u00f6r\u00fcn finansman\u0131na ili\u015fkin su\u00e7lar” ile ilgili soru\u015fturma, kovu\u015fturma ve kesinle\u015fmi\u015f mahkumiyet h\u00fck\u00fcmleri ertelenecek.<\/p>\n\n\n\n

Bu kapsam\u0131nda, zamana\u015f\u0131m\u0131 s\u00fcresi olmaks\u0131z\u0131n 15 y\u0131l\u0131n alt\u0131ndaki su\u00e7larda 5 y\u0131l, 15 y\u0131l\u0131n \u00fczerindeki su\u00e7larda ise 10 y\u0131l ceza ertelemesi \u00f6ng\u00f6r\u00fcl\u00fcyor. Belirtilen s\u00fcre su\u00e7 i\u015flenmeksizin ge\u00e7irildi\u011fi takdirde “kovu\u015fturma yap\u0131lmas\u0131na yer olmad\u0131\u011f\u0131” veya “d\u00fc\u015fme” karar\u0131 verilecek.<\/p>\n\n\n\n

Kanunun h\u00fck\u00fcmlerini Cumhurba\u015fkan\u0131 y\u00fcr\u00fctecek.<\/h3>\n\n\n\n

Teklif, \u00f6rg\u00fct faaliyeti kapsam\u0131nda i\u015flenen kasten \u00f6ld\u00fcrme su\u00e7u ile 1 Haziran 2005 tarihinden \u00f6nce i\u015flenen ve m\u00fcebbet ya da a\u011f\u0131rla\u015ft\u0131r\u0131lm\u0131\u015f m\u00fcebbet hapis cezas\u0131n\u0131 gerektiren su\u00e7lar\u0131 kapsam\u0131 d\u0131\u015f\u0131nda b\u0131rak\u0131yor.
\u00d6rg\u00fct mensuplar\u0131 i\u00e7in alt\u0131 ayl\u0131k ba\u015fvuru s\u00fcreci ba\u015flayacak. T\u00fcrkiye’de ba\u015fvuru yapacaklar adli makamlara, yurtd\u0131\u015f\u0131nda olanlar ilgili makamlara ba\u015fvuru yaparak kanundan yararlanabilecek.<\/p>\n\n\n\n

\u00d6rg\u00fct faaliyeti \u00e7er\u00e7evesinde i\u015flenen \u201ckasten \u00f6ld\u00fcrme su\u00e7u\u201d da kapsam d\u0131\u015f\u0131nda tutulacak. Milli \u0130stihbarat Te\u015fkilat\u0131 (M\u0130T) ve Milli G\u00fcvenlik Kurulu (MGK) raporlar\u0131 da belirleyici nitelikte olacak.<\/p>\n\n\n\n

Teklife g\u00f6re kanunun uygulanmas\u0131n\u0131 takip etmek \u00fczere Cumhurba\u015fkan\u0131 Yard\u0131mc\u0131s\u0131 ba\u015fkanl\u0131\u011f\u0131nda; Adalet, D\u0131\u015fi\u015fleri, \u0130\u00e7i\u015fleri ve Milli Savunma bakanlar\u0131, Cumhurba\u015fkanl\u0131\u011f\u0131 Genel Sekreteri, M\u0130T Ba\u015fkan\u0131 ile MGK Genel Sekreterinden olu\u015fan bir Kurul g\u00f6rev yapacak.<\/p>\n\n\n\n

Kanun kapsam\u0131nda verilen g\u00f6revler, ilgili kamu kurum ve kurulu\u015flar\u0131nca ivedilikle yerine getirilecek, kanunun ama\u00e7 ve faaliyetleri kapsam\u0131nda verilen g\u00f6revleri yerine getiren ki\u015filerin bu g\u00f6revleri nedeniyle hukuk\u00ee, idar\u00ee veya ceza\u00ee sorumlulu\u011fu do\u011fmayacak. Kanunun h\u00fck\u00fcmlerini Cumhurba\u015fkan\u0131 y\u00fcr\u00fctecek.<\/p>\n\n\n\n

“Milli Dayan\u0131\u015fma ve Toplumsal B\u00fct\u00fcnle\u015fmenin G\u00fc\u00e7lendirilmesi” ismi verilen teklifi \u015fu ana kadar AKP, MHP, DEM Parti, H\u00dcDA PAR, butlan y\u00f6netimi alt\u0131ndaki CHP ve Yeni Yol Grubu’ndan baz\u0131 milletvekilleri imzalad\u0131.<\/p>\n\n\n\n
