G\u00fcney Avrupa \u00fclkesi Portekiz<\/a>‘de kamuya a\u00e7\u0131k alanlarda y\u00fcz\u00fcn tamamen kapat\u0131lmas\u0131n\u0131 yasaklayan ve kamuoyunda “burka yasas\u0131” olarak adland\u0131r\u0131lan d\u00fczenleme, Cumhurba\u015fkan\u0131 Antonio Jose Seguro\u2019nun imzas\u0131yla resmen y\u00fcr\u00fcrl\u00fc\u011fe girdi. Parlamentoda iktidardaki merkez sa\u011f Sosyal Demokrat Parti (PSD) ile a\u015f\u0131r\u0131 sa\u011fc\u0131 Chega (Yeter) Partisi’nin deste\u011fiyle temmuz ay\u0131nda kabul edilen yasa, \u00f6zellikle M\u00fcsl\u00fcman kad\u0131nlar<\/a>\u0131 hedef ald\u0131\u011f\u0131 gerek\u00e7esiyle \u00fclkede derin bir siyasi ve toplumsal tart\u0131\u015fma ba\u015flatt\u0131.<\/p>\n\n\n\n

Bir kad\u0131n\u0131 k\u00fclt\u00fcrel veya dini gerek\u00e7elerle y\u00fcz\u00fcn\u00fc \u00f6rtmeye zorlamak da su\u00e7 kapsam\u0131na al\u0131nd\u0131<\/strong>.<\/p>\n\n\n\n

Yeni d\u00fczenleme, ki\u015finin kimli\u011finin tespit edilmesini engellemek amac\u0131yla kamusal alanlarda y\u00fcz\u00fc \u00f6rten k\u0131yafetlerin kullan\u0131lmas\u0131n\u0131 yasakl\u0131yor. Yasa kapsam\u0131nda havaalanlar\u0131, diplomatik misyonlar ve ibadethaneler gibi alanlar istisna tutulurken, yasa\u011fa uymayanlara 200 ila 4 bin avro aras\u0131nda para cezas\u0131 \u00f6ng\u00f6r\u00fcl\u00fcyor. Ayr\u0131ca bir kad\u0131n\u0131 k\u00fclt\u00fcrel veya dini gerek\u00e7elerle y\u00fcz\u00fcn\u00fc \u00f6rtmeye zorlamak da su\u00e7 kapsam\u0131na al\u0131nd\u0131. Bu fiili i\u015fleyenlere 3 y\u0131la kadar hapis cezas\u0131 verilebilecek. Yasak burka ve nikab gibi y\u00fcz\u00fc tamamen \u00f6rten giysileri kaps\u0131yor. Sa\u00e7\u0131 ve boynu \u00f6rten ancak kad\u0131n\u0131n y\u00fcz\u00fcn\u00fcn a\u00e7\u0131kta oldu\u011fu normal ba\u015f\u00f6rt\u00fcs\u00fc \/ tesett\u00fcr tarz\u0131n\u0131 yasaklam\u0131yor.<\/p>\n\n\n\n

Karar\u0131n ard\u0131ndan a\u00e7\u0131klama yapan Cumhurba\u015fkan\u0131 Seguro, d\u00fczenlemenin “b\u00fcy\u00fck bir sosyal ve k\u00fclt\u00fcrel hassasiyet” ta\u015f\u0131d\u0131\u011f\u0131n\u0131 savundu.<\/p>\n\n\n\n

Merkez sol Sosyalist Parti (PS), d\u00fczenlemenin \u0130slamofobik bir yakla\u015f\u0131m ta\u015f\u0131d\u0131\u011f\u0131n\u0131 ve radikalle\u015fme riskini art\u0131raca\u011f\u0131n\u0131 vurgulad\u0131. Portekiz Kom\u00fcnist Partisi (PCP) yasa\u011f\u0131n kad\u0131n haklar\u0131yla ilgisi olmad\u0131\u011f\u0131n\u0131, yabanc\u0131 d\u00fc\u015fmanl\u0131\u011f\u0131n\u0131 besleyece\u011fini belirtti. S\u00fcre\u00e7te Portekiz Barolar Birli\u011fi, Ba\u015fsavc\u0131l\u0131k Y\u00fcksek Konseyi ve Portekiz Kad\u0131n Hukuk\u00e7ular Derne\u011fi de olumsuz g\u00f6r\u00fc\u015f bildirdi. Gruplar ayr\u0131ca d\u00fczenlemenin anayasaya ayk\u0131r\u0131l\u0131k ta\u015f\u0131d\u0131\u011f\u0131 y\u00f6n\u00fcndeki endi\u015felerini dile getirdi.<\/p>\n\n\n\n

Portekiz\u2019de pe\u00e7e ve burka tart\u0131\u015fmas\u0131, May\u0131s 2024 se\u00e7imlerinde oylar\u0131n\u0131 art\u0131rarak y\u00fczde 22 oy oran\u0131yla \u00fclkenin \u00fc\u00e7\u00fcnc\u00fc b\u00fcy\u00fck siyasi g\u00fcc\u00fc haline gelen a\u015f\u0131r\u0131 sa\u011fc\u0131 Chega (Yeter) Partisi’nin hamlesiyle ivme kazand\u0131. Chega’n\u0131n “g\u00fcvenlik” s\u00f6ylemleri alt\u0131nda meclise getirdi\u011fi yasa tasar\u0131s\u0131, iktidardaki merkez sa\u011f Sosyal Demokrat Parti’nin (PSD) de deste\u011fiyle Temmuz 2025’te parlamentoda kabul edildi. Orijinal taslak, burka ve nikab gibi \u0130slami giysileri a\u00e7\u0131k\u00e7a hedef al\u0131yordu. Ancak, Portekiz Cumhuriyeti Anayasas\u0131’n\u0131n 41. maddesi uyar\u0131nca din \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fcn korunmas\u0131 gibi mevcut anayasal g\u00fcvenceler \u0131\u015f\u0131\u011f\u0131nda, tamamen ba\u015far\u0131s\u0131z olmamas\u0131 i\u00e7in daha sonra revize edildi . Sol partilerin “yabanc\u0131 d\u00fc\u015fmanl\u0131\u011f\u0131 ve \u0130slamofobi”, hukuk kurumlar\u0131n\u0131n ise “anayasaya ayk\u0131r\u0131l\u0131k” uyar\u0131lar\u0131na ra\u011fmen yasa tasar\u0131s\u0131 nihai onay i\u00e7in Cumhurba\u015fkan\u0131 Ant\u00f3nio Jos\u00e9 Seguro’nun masas\u0131na g\u00f6nderilmi\u015fti. Seguro’nun imzas\u0131yla birlikte yakla\u015f\u0131k 40 bin M\u00fcsl\u00fcman\u0131n ya\u015fad\u0131\u011f\u0131 Portekiz, Fransa, Avusturya, Bel\u00e7ika ve Hollanda gibi pe\u00e7e yasa\u011f\u0131n\u0131 uygulayan Avrupa \u00fclkeleri aras\u0131na kat\u0131ld\u0131.<\/p>\n\n\n\n
