A\u011f\u0131r Ceza Mahkemesi taraf\u0131ndan tahliyeleri\u00a0 red edilen Mustafa Balbay ve Mehmet Haberal\u2019\u0131n durumlar\u0131 ile ilgili bir a\u00e7\u0131klama yapan CHP Genel Ba\u015fkan\u0131 K\u0131l\u0131\u00e7daro\u011flu, \u201cBu karar milletin iradesine vurulmu\u015f bir darbedir\u201d ifadesini kulland\u0131.<\/strong><\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7daro\u011flu\u00a0\u00a0 3,5 saat s\u00fcren MYK (Merkez Y\u00f6netim Kurulu) toplant\u0131s\u0131n\u0131n ard\u0131ndan yapt\u0131\u011f\u0131 a\u00e7\u0131klamada Mustafa Balbay ve Mehmet Haberal hakk\u0131nda verilen karar\u0131n demokrasiye ayk\u0131r\u0131 oldu\u011funu ve halk\u0131n iradesine vurulan bir darbe oldu\u011funu belirtti. Konu\u015fmas\u0131nda Haberal ve Balbay\u2019\u0131n milletvekili se\u00e7ilmelerinde hi\u00e7bir engel olmad\u0131\u011f\u0131n\u0131, bu karar\u0131n Resmi Gazete&#8217;de yay\u0131nlanm\u0131\u015f ve\u00a0 TBMM&#8217;ye bildirilmi\u015f oldu\u011funu, bu karar\u0131 bildiren organ\u0131n da YSK oldu\u011funa dikkat \u00e7eken K\u0131l\u0131\u00e7daro\u011flu: Savc\u0131l\u0131\u011fa gider ba\u015fvurursunuz, milletvekili olman\u0131za hi\u00e7bir sak\u0131nca olmad\u0131\u011f\u0131na ili\u015fkin yaz\u0131 al\u0131rs\u0131n\u0131z, ilgili partiye ba\u015fvurursunuz, arkas\u0131ndan ilgili parti dosyan\u0131z\u0131 YSK\u2019ya g\u00f6nderir. YSK karar al\u0131r bunlar\u0131n milletvekili se\u00e7imine girmelerinden sak\u0131nca yok diye bize bildirir. Sonra halk\u0131n iradesine gideriz. Halk kimin milletvekili se\u00e7ilmesini istiyorsa oyunu kullan\u0131r ve onlar kazan\u0131rsa yarg\u0131ya ba\u015fvururlar, yarg\u0131 onlar\u0131n kazand\u0131klar\u0131na karar verir ve mazbatalar\u0131n\u0131 al\u0131rlar. Sonra bunlar TBMM\u2019ye gelir. YSK karar\u0131ndan sonra kesinle\u015fir. Kararlar \u00e7\u0131kar, Resmi Gazetede yay\u0131nlan\u0131r, kesinle\u015fir, isimleri belirtilir. YSK, TBMM\u2019ye bildirir, arkas\u0131ndan da bunlar yasalar\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc \u015fekilde parlamentoya gelirler, yemin t\u00f6reninde haz\u0131r bulunurlar.\u201d dedi.<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7daro\u011flu s\u00f6zlerine \u015f\u00f6yle devam etti: \u201c\u015eimdi deniyor ki &#8216;efendim belgeler, deliller toplanamad\u0131. O nedenle biz bunlar\u0131 serbest b\u0131rakam\u0131yoruz&#8217;.<strong> <\/strong>3 y\u0131ld\u0131r delilleri toplamak i\u00e7in CHP mi g\u00f6revliydi? Hangi \u00fclkede, hangi evrensel demokrasinin, hukuk kurallar\u0131n\u0131n ge\u00e7erli oldu\u011fu bir \u00fclkede 3 y\u0131ld\u0131r insanlar\u0131 i\u00e7eri atacaks\u0131n\u0131z? &#8216;Efendim deliller toplanamad\u0131&#8217; 20 y\u0131l olsa, 20 y\u0131l m\u0131 i\u00e7erde kalacak?&#8221;<\/p>\n<p style=\"text-align: justify;\">\u00a0<strong>S\u00dcREC\u0130 S\u00dcKUNETLE TAK\u0130P EDECE\u011e\u0130Z<\/strong><\/p>\n<p style=\"text-align: justify;\">Haberal ve Balbay\u2019\u0131n parlamentoda yemin etmeleri gerekti\u011fini ve avukatlar\u0131n\u0131n bir \u00fcst mahkeme olan 14. A\u011f\u0131r Ceza mahkemesine de itiraz ba\u015fvurusu yapacaklar\u0131n\u0131 ve bu s\u00fcreci suk\u00fcnetle takip edeceklerini dile getiren K\u0131l\u0131\u00e7daro\u011flu bu karar\u0131n halk\u0131n iradesini hi\u00e7e saymak oldu\u011funu belirterek: \u201c&#8221;Hani halk en b\u00fcy\u00fck g\u00fc\u00e7t\u00fc? Bunlar\u0131 ba\u015fka bir \u00fclkenin halk\u0131 m\u0131 gelip se\u00e7ti? Bizim \u00fclkenin halk\u0131 se\u00e7ti. Halk\u0131n iradesine sayg\u0131 g\u00f6sterecekseniz bu yarg\u0131 karar\u0131 halk\u0131n iradesine vurulan bir darbedir bunun bilinmesi laz\u0131m. Biz s\u00fckunetle itiraz sonucunu bekleyece\u011fiz ve umuyoruz ki evrensel hukuk galip gelir, bu \u00fclkede yarg\u0131\u00e7lar da var diyebilece\u011fimiz bir ortam tesis eder. Halk\u0131n iradesine sayg\u0131 duymayan yarg\u0131 arac\u0131l\u0131\u011f\u0131yla ben politikay\u0131 nas\u0131l dizayn ederim diye yola \u00e7\u0131kanlar\u0131n ay\u0131pland\u0131\u011f\u0131 bir karar ortaya \u00e7\u0131km\u0131\u015f olur, arzumuz bu. Hukuk, demokrasi egemen olsun bu \u00fclkede. Yasama organ\u0131n\u0131n ne demek oldu\u011fu bilinsin bu \u00fclkede. Milletvekilini se\u00e7eceksiniz birileri kalkacak evrensel hukuku da, halk\u0131n iradesini de hi\u00e7e sayarak yok efendim ben b\u00f6yle karar ald\u0131m diyecek. Bu \u00fclkede demokrasi bu kadar ucuzlamad\u0131, kimse kusura bakmas\u0131n.&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7daro\u011flu, &#8221;\u00d6zellikle de bunu en iyi bilmesi gereken yarg\u0131\u00e7lar\u0131n uymas\u0131 laz\u0131m. Bu kararla demokrasi yara alm\u0131\u015ft\u0131r. Oysa bizim g\u00f6revimiz demokrasiyi y\u00fcceltmek, derinle\u015ftirmektir. Halk\u0131n iradesine sayg\u0131 duyulan bir demokratik d\u00fczeni bu \u00fclkeye getirmektir. \u00dc\u00e7 ki\u015finin, iki ki\u015finin iradesini kalk\u0131p halk\u0131n iradesinin \u00fczerine tesis etmek demokrasi de\u011fildir&#8221; s\u00f6zlerini kulland\u0131.<\/p>\n<p style=\"text-align: justify;\"><strong>CUMHURBA\u015eKANI ABDULLAH G\u00dcL\u2019E \u00c7A\u011eRI<\/strong><\/p>\n<p style=\"text-align: justify;\">22. D\u00f6nem Yasama Y\u0131l\u0131 a\u00e7\u0131l\u0131\u015f konu\u015fmas\u0131nda Cumhurba\u015fkan\u0131 Abdullah G\u00fcl\u2019\u00fcn uzun tutukluluk s\u00fcrelerinden \u015fikayetini dile getirmi\u015f oldu\u011funa da de\u011finen K\u0131l\u0131\u00e7daro\u011flu, Cumhurba\u015fkan\u0131 Abdullah G\u00fcl\u2019\u00fcn bu s\u00fcrece m\u00fcdahale etmesi gerekti\u011fini ve yap\u0131lmas\u0131 gerekenlerin bir an \u00f6nce yap\u0131lmas\u0131 i\u00e7in harekete ge\u00e7ilmesi gerekti\u011fini dile getirdi.<\/p>\n<p style=\"text-align: justify;\">K\u0131l\u0131\u00e7daro\u011flu: \u201cBu \u00fclkenin cumhurba\u015fkan\u0131 dahil AH\u0130M dahil, pek \u00e7ok hukuk \u00e7evresi, akl\u0131 ba\u015f\u0131nda olan her yurtta\u015f al\u0131nan bu karara tepki g\u00f6stermek zorundad\u0131r. Demokrasi, hepimiz i\u00e7in vard\u0131r, hukuk hepimiz i\u00e7in vard\u0131r. Birileri i\u00e7in demokrasi, birileri i\u00e7in hukuk olmaz.
