Mahkeme karar\u0131nda Milli E\u011fitim Bakanl\u0131\u011f\u0131 \u0130dari ve Mali \u0130\u015fler Daire Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan banka promosyonlar\u0131yla ilgili 27 Ocak 2010 tarih ve 367 say\u0131l\u0131 i\u015flem ile yay\u0131mlanan 2010\/08 say\u0131l\u0131 genelgeye g\u00f6re 1 \u015eubat 2010 tarihinden itibaren Milli E\u011fitim Bakanl\u0131\u011f\u0131\u2019na ba\u011fl\u0131 okul ve kurumlar\u0131n bankalarla yapaca\u011f\u0131 \u2018\u2018Maa\u015f \u00d6deme Protokollerine\u2019\u2019\u00a0 ba\u011fl\u0131 olarak edinilecek parasal kaynaklar\u0131n tamam\u0131n\u0131n \u00e7al\u0131\u015fan personele da\u011f\u0131t\u0131lmas\u0131na karar verildi\u011fi ifade edildi.<\/p>\n<p style=\"text-align: justify\">Kararda, \u201cDi\u011fer taraftan dava konusu edilen protokol\u00fcn onay tarihi olan 10.08.2010 tarihinde y\u00fcr\u00fcrl\u00fckte olan 2007\/21 say\u0131l\u0131 Ba\u015fbakanl\u0131k Genelgesi\u2019nin de\u011fi\u015fik 4. maddesi ile de banka taraf\u0131ndan verilecek promosyon miktar\u0131n\u0131n tamam\u0131n\u0131n personele da\u011f\u0131t\u0131laca\u011f\u0131 kurala ba\u011fland\u0131\u011f\u0131 anla\u015f\u0131lm\u0131\u015f olup E\u011firdir \u0130l\u00e7e Milli E\u011fitim M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile Halk Bankas\u0131 aras\u0131nda maa\u015f protokol\u00fc yap\u0131lmas\u0131na ili\u015fkin 05.08.2010 tarihinde imzalan\u0131p 10.08.2010 tarihinde onaylanan komisyon karar\u0131nda aksi y\u00f6nde d\u00fczenlemelere yer verildi\u011fi g\u00f6r\u00fcld\u00fc\u011f\u00fcnden, dava konusu i\u015flemde hukuka uygunluk bulunmam\u0131\u015ft\u0131r.\u201d \u0130fadelerine de yer verildi.<\/p>\n<p style=\"text-align: justify\">Daha \u00f6nce Ba\u015fbakanl\u0131k Genelgesi\u2019nin 4. maddesinde yer alan ibarede, \u201cMilli E\u011fitim Bakanl\u0131\u011f\u0131 \u0130dari ve Mali \u0130\u015fler Daire Ba\u015fkanl\u0131\u011f\u0131 taraf\u0131ndan banka promosyonlar\u0131 ile ilgili olarak Ba\u015fbakanl\u0131k Genelgesi\u2019nin banka taraf\u0131ndan verilecek promosyon miktar\u0131n\u0131n tamam\u0131n\u0131n personele da\u011f\u0131t\u0131laca\u011f\u0131 genel ilke olmak \u00fczere, toplam miktar\u0131n \u00fc\u00e7te birini ge\u00e7memek \u00fczere Komisyon\u2019ca belirlenecek tutar, birim personelinin ihtiya\u00e7lar\u0131 do\u011frultusunda kullan\u0131lmak \u00fczere ayr\u0131labilecektir\u2019\u2019denilmekteydi.
