CHP Eski\u015fehir Milletvekili S\u00fcheyl Batum: &#8220;Tutukluluk s\u00fcreleri art\u0131k bir hukuk konusu de\u011fil, vicdan ve ahlak sorunu haline gelmi\u015ftir.&#8221;<\/p>\n<p style=\"text-align: justify;\">Toplant\u0131ya milletvekillerinin yan\u0131 s\u0131ra Ergenekon davas\u0131 nedeniyle tutuklu bulunan Mehmet Haberal, Mustafa Balbay ve Tuncay \u00d6zkan&#8217;\u0131n yak\u0131nlar\u0131 da kat\u0131ld\u0131.<\/p>\n<p style=\"text-align: justify;\">Toplant\u0131da s\u00f6z alan S\u00fcheyl Batum \u015f\u00f6yle konu\u015ftu: &#8220;Tutuklular konusu, art\u0131k salt bir hukuk konusu olmaktan \u00e7\u0131km\u0131\u015ft\u0131r. Bir ahlak ve vicdan sorunu olmu\u015ftur. Bu durum, art\u0131k medya i\u00e7in de haber alma ve verme sorunu de\u011fil, toplumsal vicdan\u0131 yans\u0131tma sorununa d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr.&#8221;<\/p>\n<p>Avrupa \u0130nsan Haklar\u0131 Mahkemesi kararlar\u0131n\u0131n da ihlal edildi\u011fini savunan Batum, &#8220;Taksiyle, paras\u0131n\u0131 kendi cebinden \u00f6deyerek mahkemeye giden ki\u015fi dahi, ka\u00e7ma \u015f\u00fcphesi var denilerek y\u0131llard\u0131r tutuklu bulunmaktad\u0131r&#8221; diye konu\u015ftu.<\/p>\n<p style=\"text-align: justify;\">Tutuklulu\u011fun ceza haline d\u00f6n\u00fc\u015ft\u00fcr\u00fcld\u00fc\u011f\u00fcn\u00fc \u00f6ne s\u00fcren milletvekili Mehmet Haberal&#8217;\u0131n karde\u015fi Ali Haberal \u015funlar\u0131 s\u00f6yledi: &#8220;Her\u015feyden \u00f6nce Mehmet Haberal bir bilim adam\u0131d\u0131r ve bilime katk\u0131lar\u0131yla \u00f6n planda olmu\u015ftur. T\u00fcrkiye&#8217;de ilk b\u00f6brek naklini ve karaci\u011fer nakillerini kendisi ger\u00e7ekle\u015ftirmi\u015ftir. T\u0131p alan\u0131ndaki ilk \u00fcniversiteyi kurmu\u015ftur. \u015eimdi ise \u00f6rg\u00fct kuruculu\u011fu ve y\u00f6neticili\u011fi ile su\u00e7lanmaktad\u0131r. Tutukluluk, art\u0131k bir ceza halini alm\u0131\u015ft\u0131r ve bu cezay\u0131 sadece tutuklular de\u011fil, yak\u0131nlar\u0131 da ya\u015famaktad\u0131r. \u00dclkemizin \u00f6n\u00fcndeki bu ay\u0131b\u0131n kald\u0131r\u0131lmas\u0131 ve adil yarg\u0131lanma istiyoruz.&#8221;<\/p>\n<p style=\"text-align: justify;\">Toplant\u0131da s\u00f6z alan Tuncay \u00d6zkan&#8217;\u0131n k\u0131z\u0131 Nazl\u0131can \u00d6zkan ise \u015funlar\u0131 s\u00f6yledi: &#8220;1155 g\u00fcn \u00f6nce babam al\u0131nd\u0131 ve bir y\u0131l \u00f6nce ilk mahkemesine \u00e7\u0131kar\u0131ld\u0131. 280 g\u00fcn \u00f6nce tecrit h\u00fccresine konuldu. Art\u0131k babam siyasi veya hukuki bir m\u00fccadele i\u00e7inde de\u011fil, bir ya\u015fam m\u00fccadelesi i\u00e7indedir. Al\u0131nd\u0131\u011f\u0131nda 15 ya\u015f\u0131ndayd\u0131m. \u015eimdi 19 ya\u015f\u0131nday\u0131m. Su\u00e7lu su\u00e7suz denilmeden ayr\u0131 b\u0131rak\u0131lmak hukuk mudur? E\u011fer bu hukuksa b\u00f6yle bir hukuktan utan\u0131yorum.&#8221;<\/p>\n<p style=\"text-align: justify;\">Tutuklu bulunan milletvekili Mustafa Balbay&#8217;\u0131n karde\u015fi Suat Balbay, se\u00e7imlerden \u00f6nce iktidar\u0131n &#8216;millet iradesini&#8217; dilinden d\u00fc\u015f\u00fcrmedi\u011fini, ancak sonras\u0131nda bu s\u00f6ylemi unuttu\u011funu belirtti\u011fi konu\u015fmas\u0131nda Silivri&#8217;de hukukun bitti\u011fini ifade etti.<\/p>\n<p style=\"text-align: justify;\">Ya\u015fam hakk\u0131, adil yarg\u0131lanma hakk\u0131 ve masumiyet karinesinin darmada\u011f\u0131n edildi\u011fini \u00f6ne s\u00fcren CHP Grup Ba\u015fkanvekili Emine \u00dclker Tarhan \u015f\u00f6yle konu\u015ftu: &#8220;Bir hukuk\u00e7u olarak hukukun bu kadar a\u011f\u0131r \u00e7i\u011fnendi\u011fi bir d\u00f6nem ya\u015fand\u0131\u011f\u0131 i\u00e7in utan\u00e7 duyuyorum. Sadece tutuklu olan milletvekillerimiz de\u011fil; pek \u00e7ok ayd\u0131n, gazeteci, bilim adam\u0131 ve ter\u00f6rle m\u00fccadele etti\u011fi halde ter\u00f6rist muamelesi yap\u0131lan insanlar\u0131 da unutmamak gerekiyor. Halk\u0131n iradesini esir alanlar, Anayasan\u0131n 90.maddesini hi\u00e7e sayanlar; demokratik bir Anayasa yap\u0131laca\u011f\u0131na inanmam\u0131z\u0131 bekliyorlar. Bu zulm\u00fcn, zorbal\u0131\u011f\u0131n bitmesi i\u00e7in Anayasa de\u011fi\u015fikli\u011fine gerek yoktur.
