Ba\u015fbu\u011f sorgu sonras\u0131 TCK\u2019n\u0131n\u00a0 314\/1. Maddesine g\u00f6re \u2018ter\u00f6r \u00f6rg\u00fct\u00fc y\u00f6neticisi olmak\u2019 \u00a0ile 321\/1 maddesine g\u00f6re de \u2018 cebir ve \u015fiddet kullanarak\u00a0 h\u00fck\u00fcmeti ortadan kald\u0131rmaya te\u015febb\u00fcs\u2019 su\u00e7lamas\u0131yla tutuklanma istemiyle N\u00f6bet\u00e7i 12. a\u011f\u0131r ceza \u00a0mahkemesine sevkedildi.<\/p>\n<p>\u0130lker Ba\u015fbu\u011f \u00a0Mahkemede verdi\u011fi ifadede \u015funlar\u0131 s\u00f6yledi:<\/p>\n<p>&nbsp;<\/p>\n<p><em>Bu su\u00e7u reddediyorum. Bu su\u00e7lamayla itham edilen ki\u015fi, <a href=\"http:\/\/www.radikal.com.tr\/index\/Turkiye_Cumhuriyeti\">T\u00fcrkiye Cumhuriyeti<\/a> Devletinin 26. Genelkurmay ba\u015fkan\u0131d\u0131r. Bunu tarihe not olarak d\u00fc\u015fmekte yarar g\u00f6r\u00fcyorum&#8230; Ben <a href=\"http:\/\/www.radikal.com.tr\/index\/Genelkurmay_Baskani\">Genelkurmay Ba\u015fkan\u0131<\/a> olarak TSK\u2019n\u0131n komutan\u0131y\u0131m ki bu TSK, d\u00fcnyan\u0131n say\u0131l\u0131 en g\u00fc\u00e7l\u00fc ordular\u0131ndan biridir. B\u00f6yle bir orduya komuta eden birisinin, silahl\u0131 ter\u00f6r \u00f6rg\u00fct\u00fc kurmak ve y\u00f6netmekle su\u00e7lanmas\u0131na ger\u00e7ekten trajikomik diyebiliriz. Ben 2002 y\u0131l\u0131 30 A\u011fustosun da orgeneralli\u011fe terfi ettim ve 2003 A\u011fustosu itibariyle Genelkurmay \u0130kinci Ba\u015fkanl\u0131\u011f\u0131 g\u00f6revine atand\u0131m. Bu g\u00f6revi yapt\u0131\u011f\u0131m 2003-2005 y\u0131llar\u0131 aras\u0131nda \u00e7e\u015fitli vesilelerle say\u0131n Cumhuraba\u015fkan\u0131 ve gerekirse say\u0131n Ba\u015fbakan ile \u00e7al\u0131\u015fmalar\u0131m\u0131z oldu. Yine bu siyasi iktidar taraf\u0131ndan 2006 y\u0131l\u0131nda Kara Kuvvetleri Komutan\u0131 olarak atand\u0131m. Yine \u015fu andaki h\u00fck\u00fcmetimiz taraf\u0131ndan, 2008-2010 y\u0131llar\u0131 aras\u0131nda Genelkurmay Ba\u015fkanl\u0131\u011f\u0131 g\u00f6revine getirildim.&#8221; <\/em><em><\/em><\/p>\n<p><em>&#8220;Say\u0131n Cumhurba\u015fkan\u0131 ve Ba\u015fbakan&#8217;la ve MGK \u00fcyesi olarak bu h\u00fck\u00fcmetin bakanlar\u0131yla birlikte \u00e7al\u0131\u015ft\u0131k. \u015eimdi elbette devletimizin istihbarat olanaklar\u0131 ve imkanlar\u0131 var. Bu kadar sene siyasi otoritenin en b\u00fcy\u00fck makamlar\u0131yla beraber \u00e7al\u0131\u015f\u0131yoruz ve benim o d\u00f6nemlerde silahl\u0131 bir ter\u00f6r \u00f6rg\u00fct\u00fc kurmam ve y\u00f6netmem tespit edilmemi\u015ftir ki bu \u00fczerinde durulmas\u0131 gereken bir nokta. Tespit edilmi\u015f ve bu g\u00f6revde tutulmu\u015fsam bu da ayr\u0131 bir nokta. Bu su\u00e7lamayla emekli olduktan 1.5 sene sonra kar\u015f\u0131 kar\u015f\u0131ya kald\u0131m. \u00c7\u00fcnk\u00fc \u00fcz\u00fcc\u00fc ve anla\u015f\u0131lmas\u0131 zor olan, e\u011fer ki benim bu faaliyetleri aktif g\u00f6revim esnas\u0131nda yapt\u0131\u011f\u0131m iddia ediliyorsa ve bu faaliyetlerim o zaman devletin yetkili makamlar\u0131nca anla\u015f\u0131lmam\u0131\u015fsa bunu da anlamak m\u00fcmk\u00fcn de\u011fildir.&#8221;<\/em><\/p>\n<p><em>&#8220;Netice olarak, b\u00f6yle bir idddiay\u0131 duymak, i\u015fitmek; silahl\u0131 kuvetler b\u00fcnyesinde \u00fclkeye ve devlete \u015ferefiyle g\u00f6rev yapm\u0131\u015f bir general olarak onuruma dokunmaktad\u0131r. Bir Genelkurmay Ba\u015fkan\u0131n\u0131n silahl\u0131 ter\u00f6r \u00f6rg\u00fct\u00fc kurmakla su\u00e7lanmas\u0131; bu bana verilecek en b\u00fcy\u00fck cezad\u0131r. Bunun bu \u015fekilde s\u00f6ylenmesi bile bana verilecek en b\u00fcy\u00fck cezad\u0131r, daha b\u00fcy\u00fc\u011f\u00fcn\u00fcn olaca\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnm\u00fcyorum.
