Bu kapsamdaki itiraz\u0131n \u00f6zg\u00fcrl\u00fckten yoksun b\u0131rakman\u0131n kanunun \u00f6ng\u00f6rd\u00fc\u011f\u00fc usule uygun olmas\u0131 \u00f6l\u00e7\u00fct\u00fc y\u00f6n\u00fcnden de\u011ferlendirilmesi gerekir. Bu kapsamdaki itiraz\u0131n \u00f6zg\u00fcrl\u00fckten yoksun b\u0131rakman\u0131n kanunun \u00f6ng\u00f6rd\u00fc\u011f\u00fc usule uygun olmas\u0131 \u00f6l\u00e7\u00fct\u00fc y\u00f6n\u00fcnden de\u011ferlendirilmesi gerekir. \u00d6zg\u00fcrl\u00fckten yoksun b\u0131rakman\u0131n hukuka uygunlu\u011fu kavram\u0131, buna karar veren merciin kanunen yetkili olmas\u0131n\u0131 da kapsamaktad\u0131r. Bu \u00e7er\u00e7evede, ba\u015fvurucunun kendisi hakk\u0131nda karar veren mahkemenin g\u00f6revli olmad\u0131\u011f\u0131, yarg\u0131lama g\u00f6revinin Y\u00fcce Divan&#8217;a ait oldu\u011fu y\u00f6n\u00fcndeki itiraz\u0131n\u0131n \u00f6zg\u00fcrl\u00fckten yoksun b\u0131rakman\u0131n hukukili\u011fine ili\u015fkin oldu\u011fu anla\u015f\u0131lmaktad\u0131r. \u0130snat edilen su\u00e7lara ili\u015fkin eylemlerin nitelendirilmesinin, davan\u0131n Y\u00fcce Divan&#8217;da g\u00f6r\u00fclmesi gerekti\u011fi iddias\u0131yla do\u011frudan ilgili oldu\u011fu, bu \u00e7er\u00e7evede yarg\u0131lama merciinin g\u00f6revli olmad\u0131\u011f\u0131yla ve eylemlerin nitelendirilmesiyle ilgili itirazlar\u0131n temyiz merciince resen dikkate al\u0131naca\u011f\u0131 a\u00e7\u0131kt\u0131r&#8221; denildi ve tahliye karar\u0131 \u00e7\u0131kt\u0131.<\/p>\n<p style=\"text-align: justify;\">Tahliye karar\u0131ndan sonra \u0130lker Ba\u015fbu\u011f\u2019un ailesi bu duruma sevindiklerini fakat di\u011fer tutsak olan ki\u015filerin de tahliye olmalar\u0131ndan ve bu haks\u0131z kumpas\u0131 d\u00fczenleyenlerin yarg\u0131lanmas\u0131ndan sonra rahata ereceklerini belirttiler.<\/p>\n<p style=\"text-align: justify;\">Tahliye sonras\u0131 \u0130lker Ba\u015fbu\u011f yapt\u0131\u011f\u0131 a\u00e7\u0131klamada; \u201cKin ve intikam ile hareket edenler hayat\u0131mdan ve \u00f6zg\u00fcrl\u00fc\u011f\u00fcmden 26 ay \u00e7ald\u0131lar\u201d dedi. \u201cSerbest b\u0131rak\u0131lmam bir ba\u015flang\u0131\u00e7.
