\u00d6calan’a \u00f6m\u00fcr boyu hapis cezas\u0131 verilmesiyle ilgili olarak Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi’nin 3’\u00fcnc\u00fc maddesinin ihlal edildi\u011fine karar verildi.<\/p>\n

Abdullah \u00d6calan 1999 y\u0131l\u0131ndaki tutuklulu\u011fu ile ilgili olarak, avukatlar\u0131 arac\u0131l\u0131\u011f\u0131yla Avrupa \u0130nsan Haklar\u0131 Mahkemesinde a\u00e7t\u0131\u011f\u0131 son davalar\u0131n nedenleri:<\/p>\n

-\u0130mral\u0131’daki ilk y\u0131llar\u0131nda sosyal izolasyonda tutulmu\u015f ve serbest b\u0131rak\u0131lma olana\u011f\u0131 olmaks\u0131z\u0131n m\u00fcebbet hapis cezas\u0131na mahkum edilmi\u015f olmas\u0131<\/p>\n

-Avukatlar\u0131 ve ailesi ile ileti\u015fimin k\u0131s\u0131tlanm\u0131\u015f olmas\u0131<\/p>\n

-Kademeli bir bi\u00e7imde zehirlendi\u011fi iddialar\u0131 ile \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesinin ihlalini belirtmesi<\/p>\n

A\u0130HM Karar\u0131:<\/p>\n

1. Mahkeme zehirleme giri\u015fimi iddialar\u0131n\u0131 oybirli\u011fiyle kabul edilemez bulmu\u015ftur.<\/p>\n

2. D\u00f6rde kar\u015f\u0131 \u00fc\u00e7 oyla, 17 Kas\u0131m 2009’a kadar tutukluluk ko\u015fullar\u0131yla ilgili olarak S\u00f6zle\u015fme’nin 3’\u00fcnc\u00fc maddesinin ihlal edildi\u011fine karar verilmi\u015ftir.<\/p>\n

3. Alt\u0131ya kar\u015f\u0131 bir oyla, 17 Kas\u0131m 2009’dan sonra cezaevi ko\u015fullar\u0131yla ilgili olarak S\u00f6zle\u015fme’nin 3’\u00fcnc\u00fc maddesinin ihlal edilmedi\u011fine karar verilmi\u015ftir.<\/p>\n

(Abdullah \u00d6calan \u015eubat 1999’dan 17 Kas\u0131m 2009 tarihine kadar \u00f6zel g\u00fcvenlikli \u0130mral\u0131 cezaevinde tek ba\u015f\u0131na tutuldu.)<\/p>\n

4. D\u00f6rde kar\u015f\u0131 \u00fc\u00e7 oyla, cezaevi ziyaretleriyle ilgili olarak S\u00f6zle\u015fme’nin \u00f6zel hayat ve aile hayat\u0131na sayg\u0131y\u0131 d\u00fczenleyen 8’inci maddesinin ihlal edilmedi\u011fine karar verilmi\u015ftir.<\/p>\n

5. Oybirli\u011fiyle S\u00f6zle\u015fme’nin 7’nci maddesinin ihlal edilmedi\u011fine karar verilmi\u015ftir.<\/p>\n

6. \u015eartl\u0131 tahliye olas\u0131l\u0131\u011f\u0131 olmaks\u0131z\u0131n \u00f6m\u00fcr boyu hapis cezas\u0131 verilmesiyle ilgili olarak S\u00f6zle\u015fme’nin 3’\u00fcnc\u00fc maddesinin ihlal edildi\u011fine oybirli\u011fiyle karar verilmi\u015ftir.<\/p>\n

7. S\u00f6zle\u015fme’nin 5, 6, 13 ve 14’\u00fcnc\u00fc maddeleri uyar\u0131nca yap\u0131lan \u015fikayetler hakk\u0131nda h\u00fck\u00fcm vermeye gerek olmad\u0131\u011f\u0131na oybirli\u011fiyle karar verilmi\u015ftir.<\/p>\n

8.
