Cezaevinde bulunanlar\u0131n 149 bin 57&#8217;si erkek, 5 bin 624&#8217;\u00fc kad\u0131nlar, 2 bin 26&#8217;s\u0131 18 ya\u015f alt\u0131ndaki \u00e7ocuklar olu\u015fturuyor. T\u00fcrkiye&#8217;de 2005 y\u0131l\u0131nda 55 bin 870 olan tutuklu ve h\u00fck\u00fcml\u00fc say\u0131s\u0131 2014 y\u0131l\u0131n\u0131n 12. ay\u0131nda y\u00fczde 180,5 oran\u0131nda art\u0131\u015fla 156 bin 707&#8217;ye y\u00fckseldi.<\/p>\n<p style=\"text-align: justify;\">Diyarbak\u0131r Barosu Cezaevi \u0130zleme Komisyonu Y\u00f6neticisi Av. Servet \u00d6zen, T\u00fcrkiye\u2019deki cezaevlerinin dolmas\u0131n\u0131, tutukluma taleplerinde ya\u015fanan art\u0131\u015flardan kaynakland\u0131\u011f\u0131n\u0131 ifade ederek, su\u00e7lulu\u011fu engellemeye y\u00f6nelik ba\u015fvurulan bir m\u00fcessese olmas\u0131ndan dolay\u0131 cezaevlerinden dolululuk oran\u0131n\u0131n artt\u0131\u011f\u0131n\u0131 s\u00f6yledi. \u00d6zen, su\u00e7 ve su\u00e7lulu\u011fu ortaya \u00e7\u0131karan toplumsal, ekonomik, sosyal, siyasal olarak toplumun su\u00e7 \u00fcretme veya su\u00e7a sevk nedenlerini ortadan kald\u0131r\u0131lmas\u0131 gerekti\u011fini ifade ederek, &#8220;Toplumsal bir mekanizman\u0131n devreye girmesiyle su\u00e7lulu\u011fu ortada kald\u0131rmak gerekiyor. Buna ili\u015fkin yasal mevzuat\u0131n uygulanmas\u0131na gereksinim duyulmamal\u0131. Mevcut TCK\u2019y\u0131 de\u011ferlendirirsek, mevcut yarg\u0131 sistemi i\u00e7inde tutukluluk istisna olmas\u0131 gerekti\u011fi yerde esasl\u0131 bir m\u00fcessese olarak uygulanmakta. Su\u00e7lulu\u011fu engellemeye y\u00f6nelik ba\u015fvurulan bir tutuklama m\u00fcessese olmas\u0131ndan dolay\u0131 cezaevlerinden dolululuk oran\u0131 artmaktad\u0131r. Mevcut mevzuat\u0131m\u0131za bakt\u0131\u011f\u0131m\u0131zda, tutuklaman\u0131n bir istisna oldu\u011funu, ba\u015fvurulmas\u0131 gereken tedbirlerden oldu\u011funu net bir \u015fekilde ortaya koymu\u015ftur. Anayasa Mahkemesi\u2019nin son d\u00f6nemlerde verdi\u011fi kararlarda, ki\u015fi g\u00fcvenli\u011fi ve h\u00fcrriyeti hakk\u0131n\u0131n \u00e7ok bariz bir \u015fekilde ihlal edildi\u011fi belirtilmi\u015fti. Anayasa Mahkemesi\u2019nin i\u00e7tihad\u0131nda g\u00f6r\u00fcld\u00fc\u011f\u00fc gibi, di\u011fer g\u00fcvenlik tedbirleri e\u011fer ger\u00e7ekten sonu\u00e7 al\u0131nam\u0131yorsa, tutuklamaya ba\u015fvurulmas\u0131 gerekiyor. Anayasa Mahkemesi\u2019nin verdi\u011fi kararlar, yerel mahkemeler i\u00e7in yol g\u00f6sterici olarak de\u011ferlendirilmeli.Tutuklama son \u00e7are olarak ba\u015fvurulmas\u0131 gerekiyor&#8221; dedi.<\/p>\n<p style=\"text-align: justify;\">Tutuklamalar\u0131n ya\u015fanmamas\u0131 i\u00e7in baz\u0131 cezalar\u0131n Kabahatler Kanunu gibi kanunlarla de\u011ferlendirilmesi gerekti\u011fini bildiren \u00d6zen, &#8220;Kimi su\u00e7 tiplerinin TCK\u2019dan \u00e7\u0131kar\u0131l\u0131p, Kabahatler Kanunu kapsam\u0131na al\u0131nmal\u0131 veya farkl\u0131 idari yap\u0131 y\u00f6ntemiyle baz\u0131 cezalara tabi tutulmal\u0131. Her \u015feyi su\u00e7luluk ve ceza-i m\u00fceyyide ile \u00e7\u00f6zmektense, farkl\u0131 y\u00f6ntemler uygulanmal\u0131. Bu uygulamalar\u0131n hayata ge\u00e7mesiyle, cezaevleri bir nebze de olsa \u0131slah edilmi\u015f olur. Cezaevlerinin kurulu\u015f amac\u0131, su\u00e7luyu tekrar topluma kazand\u0131rmay\u0131 ama\u00e7 edinirken, T\u00fcrkiye\u2019de cezaevlerinin bug\u00fcnk\u00fc ko\u015fullar\u0131 bundan \u00e7ok uzak durumda. Bu da asl\u0131nda tekrar su\u00e7lu \u00fcretiyordur&#8221; diye konu\u015ftu.<\/p>\n<p style=\"text-align: justify;\"><strong>365 CEZAEV\u0130 DOLMAK \u00dcZERE<\/strong><br \/>\nT\u00fcrkiye&#8217;de 302 kapal\u0131, 52 m\u00fcstakil a\u00e7\u0131k ceza infaz kurumu, 2 \u00e7ocuk e\u011fitimevi, 5 kad\u0131n kapal\u0131, bir kad\u0131n a\u00e7\u0131k, 3 \u00e7ocuk kapal\u0131 ceza infaz kurumu olmak \u00fczere toplam 365 ceza infaz kurumu bulunuyor. Cezaevleri 159 bin 475 ki\u015fi kapasiteli. Mevcut tutuklu ve h\u00fck\u00fcml\u00fc say\u0131s\u0131 156 bin 707. Cezaevlerinin kapasitesinin dolmas\u0131na ise sadece 2 bin 768 ki\u015fi kald\u0131.<\/p>\n<p style=\"text-align: justify;\"><strong>MARMARA \u0130LK SIRADA<\/strong><br \/>\nTutuklu ve h\u00fck\u00fcml\u00fclerin b\u00f6lgelere g\u00f6re da\u011f\u0131l\u0131m\u0131nda Marmara B\u00f6lgesi 44 bin 305 ile ilk s\u0131rada yer al\u0131rken, Marmara&#8217;y\u0131 25 bin 364 ile Ege B\u00f6lgesi, 22 bin 950 ile Akdeniz B\u00f6lgesi, 21 bin 849 ile \u0130\u00e7 Anadolu B\u00f6lgesi, 19 bin 72 ile Karadeniz B\u00f6lgesi, 13 bin 107 ile G\u00fcneydo\u011fu Anadolu B\u00f6lgesi, 9 bin 896 ile Do\u011fu Anadolu B\u00f6lgesi izledi.<\/p>\n<p style=\"text-align: justify;\"><strong>HIRSIZLIK \u0130LK SIRADA<\/strong><br \/>\nT\u00fcrkiye&#8217;de cezaevlerini, h\u0131rs\u0131zl\u0131k ve adam \u00f6ld\u00fcrme su\u00e7lar\u0131ndan giren tutuklu ve h\u00fck\u00fcml\u00fcler dolduruyor. Cezaevlerinde bulunanlar\u0131n baz\u0131 su\u00e7lar\u0131na g\u00f6re da\u011f\u0131l\u0131m\u0131nda ilk s\u0131ray\u0131 32 bin 663 ile h\u0131rs\u0131zl\u0131k al\u0131yor.
