Kazada hayat\u0131n\u0131 kaybeden polis memuru \u0130smet Fatih Alag\u00f6z\u2019\u00fcn e\u015fi \u00d6zlem Alag\u00f6z, a\u011fabeyleri Mehmet Akif Alag\u00f6z ile Zafer Mustafa Alag\u00f6z ve taraf avukatlar\u0131 da duru\u015fmada haz\u0131r bulundu. Sinan \u00c7etin, o\u011flunun duru\u015fmas\u0131na kat\u0131lmad\u0131. R\u00fczgar \u00c7etin\u2019in duru\u015fma boyunca ba\u015f\u0131 \u00f6ne e\u011fik duru\u015fu dikkat \u00e7ekti.<\/p>\n<p style=\"text-align: justify;\">Duru\u015fman\u0131n ba\u015flamas\u0131n\u0131n ard\u0131ndan san\u0131k vekilleri taraf\u0131ndan \u00f6zel olarak ald\u0131r\u0131lan bilirki\u015fi raporu okundu. \u0130stanbul Teknik \u00dcniversitesi (\u0130T\u00dc) g\u00f6revli \u00f6\u011fretim \u00fcyesi 2 trafik uzman\u0131 taraf\u0131ndan haz\u0131rlanan raporda, s\u00fcr\u00fcc\u00fc R\u00fczgar \u00c7etin\u2019in alkoll\u00fc olarak ara\u00e7 kulland\u0131\u011f\u0131, olay mahalline geldi\u011finde sollama yasa\u011f\u0131n\u0131 g\u00f6steren devaml\u0131 \u00e7izgiye ra\u011fmen \u00f6n\u00fcnde seyreden arac\u0131 sollad\u0131\u011f\u0131 anlat\u0131ld\u0131. \u00c7etin\u2019in s\u00fcratli ve alkoll\u00fc olmas\u0131 sebebiyle kontrol\u00fc sa\u011flayamay\u0131p orta \u015feridi de a\u015farak aksi istikamette kendi \u015feridinde seyreden polis otosunun \u015feridine girerek \u00e7arpt\u0131\u011f\u0131 belirtilerek, \u201cBu hareketleri kanun gere\u011fi asli kusur kabul edildi\u011fi anla\u015f\u0131lmakla asli kusurlu g\u00f6r\u00fclm\u00fc\u015ft\u00fcr\u201d denildi.<\/p>\n<p style=\"text-align: justify;\">Raporda, celse aras\u0131 mahkemeye \u015fikayetinden vazge\u00e7ti\u011fini i\u00e7eren bir dilek\u00e7e sunan m\u00fc\u015fteki Emre Tetik\u2019in, kendi \u015feridinde seyrederek kural ihlali yapmad\u0131\u011f\u0131ndan kusursuz oldu\u011fu kanaatine var\u0131ld\u0131\u011f\u0131 ifade edildi.<\/p>\n<p style=\"text-align: justify;\"><strong>R\u00dcZGAR \u00c7ET\u0130N ASL\u0130 KUSURLU<\/strong><\/p>\n<p style=\"text-align: justify;\">Raporda ayr\u0131ca, \u015fehit \u0130smet Alag\u00f6z ve m\u00fc\u015fteki s\u00fcr\u00fcc\u00fc Emre Tetik\u2019in emniyet kemeri takmad\u0131klar\u0131 belirtilerek \u201cM\u00fc\u015fteki ve maktul\u00fcn emniyet kemeri takmad\u0131klar\u0131 anla\u015f\u0131lmaktad\u0131r. M\u00fc\u015fteki ve maktul\u00fcn emniyet kemeri takmalar\u0131 halinde \u00f6l\u00fcm ve yaralanmalar\u0131n meydana gelmeyebilece\u011fi anla\u015f\u0131lmaktad\u0131r. Bu sebeple kazan\u0131n meydana gelmesinde s\u00fcr\u00fcc\u00fc R\u00fczgar \u00c7etin tam kusurlu g\u00f6r\u00fclse de kazan\u0131n \u00f6l\u00fcmle sonu\u00e7lanmas\u0131nda maktul ve m\u00fc\u015ftekinin yaralanmas\u0131na yol a\u00e7t\u0131\u011f\u0131 g\u00f6z \u00f6n\u00fcne al\u0131n\u0131rsa R\u00fczgar \u00c7etin\u2019in asli kusurlu oldu\u011fu ancak tam kusurlu olarak g\u00f6r\u00fclemeyece\u011fi kanaatine var\u0131lm\u0131\u015ft\u0131r\u201d ifadelerine yer verildi.<\/p>\n<p style=\"text-align: justify;\"><strong>\u201cRAPORU KABUL ETM\u0130YORUZ\u201d<\/strong><\/p>\n<p style=\"text-align: justify;\">Raporun okunmas\u0131n\u0131n ard\u0131ndan s\u00f6z alan m\u00fc\u015fteki avukatlar\u0131, raporu kabul etmediklerini belirterek, bu raporun dosyaya etki etmeyece\u011fini belirttiler. Avukat Y\u0131lmaz Aba\u015fo\u011flu, \u201cKaza kameralara a\u00e7\u0131k bir \u015fekilde yans\u0131m\u0131\u015ft\u0131r. Su\u00e7un s\u00fcbut buldu\u011fu kanaatindeyiz. Ma\u011fdur Emre Tetik\u2019in \u015fikayetten vazge\u00e7mi\u015f olmas\u0131 belirlenecek ceza a\u00e7\u0131s\u0131ndan etkili olmayacakt\u0131r\u201d ifadelerini kulland\u0131.<\/p>\n<p style=\"text-align: justify;\">San\u0131k avukatlar\u0131 ise rapora de\u011finerek, bilin\u00e7li taksirin olu\u015fmad\u0131\u011f\u0131n\u0131 \u00f6ne s\u00fcrd\u00fcler.
