1 Haziran 2013 tarihinde Ankara K\u0131z\u0131lay Meydan\u0131’ndaki Gezi eylemleri esnas\u0131nda Ethem Sar\u0131s\u00fcl\u00fck’\u00fcn \u00f6ld\u00fcr\u00fclmesiyle ilgili davada, san\u0131k polis memuru Ahmet \u015eahbaz 1 y\u0131l 4 ay 20 g\u00fcn hapis cezas\u0131na \u00e7apt\u0131r\u0131ld\u0131. Mahkeme heyeti cezay\u0131 10 bin 100 lira para cezas\u0131na \u00e7evirdi.<\/p>\n

Olay, 1 Haziran 2013\u2019te Ankara K\u0131z\u0131lay Meydan\u0131\u2019nda ya\u015fanm\u0131\u015ft\u0131. Edinilen bilgiye g\u00f6re, Ethem Sar\u0131s\u00fcl\u00fck, gezi eylemlerine destek amac\u0131yla K\u0131z\u0131lay Meydan\u0131’nda yap\u0131lan protesto s\u0131ras\u0131nda ba\u015f\u0131na isabet eden kur\u015funla hayat\u0131n\u0131 kaybetmi\u015fti. Sar\u0131s\u00fcl\u00fck\u2019\u00fc vurdu\u011fu su\u00e7lamas\u0131yla tutuklanan ve Ankara 6’nc\u0131 A\u011f\u0131r Ceza Mahkemesi’nde ‘olas\u0131 kastla adam \u00f6ld\u00fcrme’ su\u00e7undan yarg\u0131lanan polis memuru Ahmet \u015eahbaz, 7 y\u0131l 9 ay 10 g\u00fcn hapis cezas\u0131 alm\u0131\u015ft\u0131. Yarg\u0131tay 1\u2019inci Ceza Dairesi, karar\u0131 usulden bozarak, dosyay\u0131 yerel mahkemeye g\u00f6nderdi ve dava g\u00fcvenlik gerek\u00e7esiyle Aksaray’da g\u00f6r\u00fclmesine karar verildi. Tutuklu olan polis memuru \u015eahbaz da tahliye olmu\u015ftu.<\/p>\n

Aksaray A\u011f\u0131r Ceza Mahkemesi\u2019nde g\u00f6r\u00fclen davan\u0131n bug\u00fcnk\u00fc duru\u015fmas\u0131na, Ethem Sar\u0131s\u00fcl\u00fck’\u00fcn annesi Sayfi ve karde\u015fleri Cem Sar\u0131s\u00fcl\u00fck, \u0130krar Sal\u0131s\u00fcl\u00fck ile taraflar\u0131n avukatlar\u0131 kat\u0131ld\u0131. Tutuksuz yarg\u0131lanan san\u0131k polis memuru Ahmet \u015eahbaz da duru\u015fmaya Ses ve G\u00f6r\u00fcnt\u00fc Bili\u015fim Sistemi (SEGB\u0130S) ile kat\u0131ld\u0131.<\/p>\n

Mahkeme Ba\u015fkan\u0131 \u0130lker Akta\u015f, 31 adet CD, Ethem Sar\u0131s\u00fcl\u00fck’\u00fcn a\u011fabeyi Mustafa Sar\u0131s\u00fcl\u00fck’\u00fcn talebi \u00fczerine haz\u0131rlanan bilirki\u015fi raporu ile T\u00dcB\u0130TAK ve TRT’den gelen raporlar\u0131n incelendi\u011fini belirtti. Heyet, san\u0131k Ahmet \u015eahbaz’\u0131n, ‘taksirle \u00f6l\u00fcme neden olma’ su\u00e7unu i\u015fledi\u011fi sabit g\u00f6r\u00fcld\u00fc\u011f\u00fc, su\u00e7un i\u015fleni\u015f bi\u00e7imi, san\u0131\u011f\u0131n taksire dayal\u0131 kusurun derecesi, meydana gelen zarar\u0131n a\u011f\u0131rl\u0131\u011f\u0131 g\u00f6z \u00f6n\u00fcne al\u0131narak 2 y\u0131l hapis cezas\u0131 verdi. Ceza, ilk \u00f6nce T\u00fcrk Ceza Kanunu’nun 27\/1 maddesi (s\u0131n\u0131r\u0131n a\u015f\u0131lmas\u0131) uyar\u0131nca 1\/6 oran\u0131nda indirim yap\u0131larak 1 y\u0131l 8 aya, iyi hal indirimiyle birlikte 1 y\u0131l 4 ay 20 g\u00fcn oldu. \nMahkeme sonras\u0131 bir a\u00e7\u0131klama yapan Sar\u0131s\u00fcl\u00fck\u2019\u00fcn avukat\u0131 Murat Y\u0131lmaz, \u201cBu davan\u0131n Ankara\u2019dan buraya al\u0131nmas\u0131n\u0131n sebebi bu 10 bin 100 TL para cezas\u0131.
